1 8. Describe any anticipated vegetation and topographic alterations outside the pit, <br /> 2 and reclamation plans consistent with the stated end use for the land; and <br /> 3 9. Existing and new nonmetallic mining operations must submit land reclamation <br /> 4 plans to the local government compatible with the purposes of this section. <br /> 5 e. River-dependent uses. River-dependent uses must comply with the following design <br /> 6 standards: <br /> 7 1. Structures and parking areas, except shoreline facilities and private roads and <br /> 8 conveyances serving river-dependent uses as provided in section 920(L) <br /> 9 (exemptions), must meet the dimensional and performance standards in this <br /> 10 section must be designed so that they are not readily visible, and must be <br /> 11 screened by establishing and maintaining natural vegetation; <br /> 12 2. Shoreline facilities must comply with Minnesota Rules,chapter 6115 and must: <br /> 13 (i) Be designed in a compact fashion so as to minimize the shoreline area <br /> 14 affected; and <br /> 15 (ii) Minimize the surface area of land occupied in relation to the number of <br /> 16 watercraft or barges to be served; and <br /> 17 3. Dredging and placement of dredged material are subject to existing federal and <br /> 18 state permit requirements and agreements. <br /> 19 f. Wireless communication towers. Wireless communication towers <br /> 20 are subject to the following additional design standards: <br /> 21 1. The applicant must demonstrate that functional coverage cannot be provided <br /> 22 through co-location,a tower at a lower height,or a tower at a location outside of the <br /> 23 MRCCA; <br /> 24 2. The tower must not be located in a bluff or shore impact zone; <br /> 25 3. Placement of the tower must minimize impacts on public river corridor views; and <br /> 26 <br /> 27 stand.:irrlgI <br /> 28 (F) Structure height and placement and lot size. <br /> 29 (1) Purpose. To establish standards that protect primary conservation areas and public river <br /> 30 corridor views from development impacts and ensure that new development is sited <br /> 31 consistent with the purpose of the MRCCA. <br /> 32 (2) Structure height. Structures and facilities must comply with the following standards unless <br /> 33 identified as exempt in section 920(L)): <br /> 34 a. Structures and facilities must comply with the following standards unless identified as <br /> 35 exempt in 920(L): <br /> 36 1. ROS District: 35 feet. <br /> 37 2. RN District: 35 feet. <br /> 38 3. SR District: Height is determined by underlying zoning, provided the allowed <br /> 39 height is consistent with that of the mature treeline,where present, and existing <br /> 40 surrounding development, as viewed from the OWHL of the opposite shore. <br /> 41 b. Height is measured on the side of the structure facing the Mississippi River. <br /> 42 C. In addition to the conditional use permit requirements of section 920(C)(4), criteria for <br /> 43 considering whether to grant a conditional use permit for structures exceeding the <br /> 44 height limits must include: <br /> 45 1. Assessment of the visual impact of the proposed structure on public river corridor <br /> 46 views, including views from other communities; <br /> 47 2. Determination that the proposed structure meets the required bluff and OHWL <br /> 48 setbacks; <br /> Page 105 of 160 <br />
