Public facilities serve the <br /> 2 public interest by providing public access to the Mississippi River corridor or require locations <br /> 3 in or adjacent to the river corridor and therefore require some degree of flexibility. <br /> 4 (2) General design standards. In addition to the standards set forth above, all public facilities <br /> 5 must be designed and constructed to: <br /> 6 a. Avoid primary conservation areas, unless no alternative exists. If no alternative exists, <br /> 17 then disturbance to primary conservation areas must be avoided to the greatest extent <br /> 18 practicable,and design and construction must minimize impacts; and <br /> 19 e. Minimize disturbance of spawning and nesting times by scheduling construction at <br /> 20 times when local fish and wildlife are not spawning or nesting. <br /> 21 (3) Right-of-way maintenance standards. Right-of-way maintenance must comply with the <br /> 22 following standards: <br /> 23 a. Vegetation currently in a natural state must be maintained to the extent feasible; <br /> 24 b. Where vegetation in a natural state has been removed, native plants must be planted <br /> 25 and maintained on the right-of-way; and <br /> 26 C. Chemical control of vegetation must be avoided when practicable, but when chemical <br /> 27 control is necessary, chemicals used must be in accordance with the regulations and <br /> 28 other requirements of all state and federal agencies with authority over the chemical's <br /> 29 use. <br /> 30 (4) Crossings of public water or public land. Crossings of public waters or land controlled by the <br /> 31 commissioner are subject to approval by the commissioner according to Minn. Stats. §§ <br /> 32 84.415 and 103G.245. <br /> 33 (5) Public utilities. Public utilities must comply with the following standards: <br /> 34 a. High-voltage transmission lines, wind energy conversion systems greater than five <br /> 35 megawatts, and pipelines are regulated according to Minn. Stats. chs. 216E, 216F, and <br /> 36 216G respectively; and <br /> 37 b. If overhead placement is necessary, utility facility crossings must minimize visibility of <br /> 38 the facility from the river and follow other existing rights-of-way as much as practicable. <br /> 39 C. The appearance of structures must be as compatible as practicable with the <br /> 40 surrounding area in a natural state with regard to height and width, materials used,and <br /> 41 color. <br /> 42 , 117 <br /> 43 congn9unicatien teweresl <br /> 44 (6) Public transportation facilities. Public transportation facilities shall comply with structure <br /> 45 placement and height standards in Section 920(F). Where such facilities intersect or about <br /> 46 two or more MRCCA districts, the least restrictive standards apply. Public transportation <br /> 47 facilities must be designed and constructed to give priority to: <br /> 48 a. Providing scenic overlooks for motorists, bicyclists, and pedestrians; <br /> 49 b.
