Voting No: None. <br /> <br />COMMISSION BUSINESS/PUBLIC HEARING <br /> <br />Case #1: <br /> <br />Review Amendment to Request for a Conditional Use Permit to Exceed Sign <br />Size and Height Restrictions; Case of Dolphin Real Estate <br /> <br />Zoning Administrator Frolik stated that in the commercial and industrial districts, the City Code <br />restricts the ground or freestanding sign size to 100 square feet (200 square feet aggregate surface <br />area). Sign heights are restricted to 25 feet from grade to top of sign. In May, Burger King <br />applied for a conditional use permit for a sign that included a 144 square foot franchise logo and <br />a 45 square foot reader board, for a total of 189 square feet. The sign height was proposed to be <br />35 feet. <br /> <br />Zoning Administrator Frolik explained that on June 1, 1999, the Planning Commission <br />conducted a public hearing regarding the original request for an 89 square foot overage in sign <br />size and a ten foot overage in sign height. The Planning Commission recommended that the City <br />Council approve the request for a conditional use permit that would limit the business <br />identification portion of the sign to 100 square feet and the reader board to 45 square feet. They <br />also recommended that the sign height be consistent with that of the Holiday Stationstore sign. <br />The Holiday sign permit indicates a height of 23 feet; therefore, it was recommended that Burger <br />King maintain compliance with the current 25 foot height restriction. <br /> <br />Zoning Administrator Frolik explained that the request and the Planning Commission's <br />recommendations were presented to City Council. At that time, the applicant informed the <br />Council that the Burger King franchise has just released their new sign design which is a 113 <br />square foot circular sign. The applicant then stated that their request was being amended to the <br />113 square foot logo sign with a 45 square foot reader board, that would comply with the 25 foot <br /> <br />Planning Commission/July 6, 1999 <br /> Page 2 of 7 <br /> <br /> <br />
