The public hearing closed at 8:59 p.m. <br /> <br />Commission Business <br /> <br />Chairperson Anderson called the regular meeting of the Planning Commission back to order at <br />8:59 p.m. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Kociscak, to recommend that <br />City Council adopt Findings of Fact in the affirmative relating to the application from Jim and <br />Kathy Weidenbach for an environmental permit for landscape alterations in the Mississippi <br />Critical and Wild and Scenic River Overlay Districts. <br /> <br />Further discussion: Commissioner Nixt stated that he is inclined to let the homeowner's work <br />with City Staff to come up with a landscaping plan, but thinks a precedent needs to be set that <br />will apply to other homeowners and determine what is equitable for the properties along the <br />river. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Commissioners Johnson, Kociscak, <br />Dempsey, Jensen, Nixt, and Wivoda. Voting No: None. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Nixt, to recommend that City <br />Council adopt Findings of Fact in the affirmative relating to the application from Terry and Jane. <br />Luke for an environmental permit for landscape alterations in the Mississippi Critical and Wild <br />and Scenic River Overlay Districts. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Commissioners Johnson, Nixt, Dempsey, <br />Jensen, Kociscak, and Wivoda. Voting No: None. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Dempsey, to recommend that <br />City Council approve Mr. Jim Weidenbach's request for an environmental permit for landscape <br />alterations in the Mississippi Critical and Wild and Scenic River Overlay Districts. <br /> <br />Further discussion: Commissioner Johnson stated that #1 in the resolution should be changed to <br />read "..a certified, licensed, or degreed landscape architect to develop a Landscape Plan, <br />considering transmittals .... "And add the sentence "Any objection to the submitted landscape <br />plan must be provided to the permit holder in writing within ten days of receipt or the plan shall <br />be deemed approved." <br /> <br />Commissioner Jensen questioned if the applicants were aware of the fine. Mr. Luke stated yes <br />and was wondering if there was anything that the City could do to reduce the fine. Community <br />Development Director Sherman stated that if a problem should arise not allowing the completion <br />of the project by the established completion date, they should contact the City in advance to <br />make other arrangements. <br /> <br />Planning Commission/June 1, 1999 <br /> Page 10 of 13 <br /> <br /> <br />
