Staff immediately notified Mr. Weidenbach and Mr. Luke to cease work and <br />implement some temporary erosion control measures until the proper permits were obtained. <br /> <br />Cindy Sherman explained that Mr. Weidenbach and Mr. Luke applied for an environmental <br />permit and submitted plans identifying pre-existing and current slopes and the extent to which rip <br />rap was installed. The purpose of the after-the-fact permit is to ensure that the project is <br />completed in accordance with Critical River, Wild and Scenic River, and MNRRA guidelines. <br />To do this, would at least require restoration of the slope and top of bluff with native vegetation <br />to mitigate the visual impact or work performed and protect the natural and scenic value of the <br />river. <br /> <br />Citizen Input <br /> <br />Commissioner Jensen questioned if any trees were removed. Community Development Director <br />Sherman stated that it was her understanding that trees had been removed. <br /> <br />Jim Weidenbach stated that he received a permit from the DNR to do the Rip Rap but once the <br />work began it was impossible to get the rock in place because the bank kept collapsing. At that <br />point they made a judgement call to slope the bank in order to get the rock down and stop the <br />erosion. He stated that in regards to the removal of trees, the only trees that were cut up were <br />trees that have already been downed by previous storms and high water. <br /> <br />Terry Luke showed pictures of the erosion last fall and some oak trees on the top of the bank <br />where half of the root system was exposed. He stated he lost at least 12 feet from erosion of the <br />bluff; something needed to be done. <br /> <br />Tom Sauter, Sauter and Sons, reviewed the work that was done and explained that the bank was <br />straight up and down and had to be tapered back to get the work done to save it from further <br />erosion. <br /> <br />Dennis Potter, 14200 Bowers Drive, stated that he is an adjacent homeowner and has lived there <br />for 20 years and watched the erosion take place year after year. Mr. Potter noted that he has seen <br />all the trees that have been in the river and feels that the restoration work that has been done is a <br />bonus to users of the river. <br /> <br />Tom Menth, 14370 Bowers Drive, stated that he watched the project being completed and <br />wished that it was being done on his property because he has lost about .six feet of his property <br />this year. <br /> <br />Motion by Commissioner Nixt, seconded by Commissioner Kociscak, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Commissioners Nixt, Kociscak, Dempsey, <br />Jensen, Johnson, and Wivoda.
