Case #6 <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR AN AUTO REPAIR <br />BUSINESS IN THE R-IR RURAL RESIDENTIAL DISTRICT; <br /> CASE OF CRAIG JOHNSON <br /> By: Acting Community Development Director Sylvia Frolik <br /> <br />Background: <br /> <br />Mr. Craig Johnson is requesting a conditional use permit to operate an auto repair business from <br />the garage on his property at 17600 Gibbon Street N.W. The subject property is approximately <br />2.5 acres in size and located in the R-1R Rural Residential District. Enclosed for your information <br />are the following items: <br /> <br />A) <br />B) <br />C) <br />D) <br />E) <br />F) <br /> <br />Site location map <br />Site plan and supporting documentation <br />Letters submitted from area residents <br />City Engineer's review (July 31, 1990) <br />Proposed Findings of Fact <br />Proposed Conditional Use Permit <br /> <br />Observations: <br /> <br />On July 17, 1990, the City received an application from Craig Johnson for a conditional use permit <br />to operate an auto repair business at his home located at 17600 Gibbon Street N.W. <br /> <br />Upon the request of City Staff, Phyllis Strong from Anoka County Environmental Services <br />inspected the subject property and notified the City that although Mr. Johnson would be generating <br />a minimum amount of hazardous materials in his auto repair operation, he would be subject to <br />hazardous waste licensing requirements. Phyllis did note that Mr. Johnson's waste management <br />practices are very good and he is not violating any regulations at this time. <br /> <br />Of the properties notified of the request, many have responded favorably contingent upon the <br />conditional use permit being limited to one or two cars on the property at any given time; and some <br />of the properties notified have expressed opposition to the request. <br /> <br />Staff Recommendations: <br /> <br />City Code indicates that conditional use permits may be issued to allow for certain uses that are <br />generally compatible in the district in which they are proposed to be located.
