SECTION 4. PROHIBITION <br /> <br />During the term of this Ordinance, notwithstanding Chapter 9 of the City Code, entitled "Zoning <br />and Subdivision of Land," no subdivision, rezoning, site plan approvals, conditional use permits <br />or variances of any kind shall be permitted and no applications for said subdivision, rezoning, <br />site plan approval, conditional use permit or variance shall be accepted on the parcels identified <br />as follows: <br /> <br />35-32-25-24-0004 <br />35-32-25-31-0011 <br />35-32-25-31-0026 <br /> <br />35-32-25-31-0005 <br />35-32-25-31-0012 <br />35-32-25-31-0027 <br /> <br />35-32-25-31-0010 <br />35-32-25-31-0025 <br />35-32-25-31-0028 <br /> <br />SECTION 5. UNDUE HARDSHIP EXCEPTIONS <br /> <br />The City Council may grant an exception to the provisions of this Ordinance when, in its <br />opinion, undue hardship may result form strict compliance. In granting an exception, the City <br />Council shall prescribe any conditions that it deems necessary to or desirable for the protection <br />of the public interest. NO exception shall be granted unless the City Council finds: <br /> <br />That there are special circumstances or conditions affecting said property such <br />that the strict application of the provisions of this Moratorium Ordinance would <br />deprive the petitioner of the reasonable use of petitioner's land. <br /> <br />That the exception is necessary for the preservation and enjoyment of a substantial <br />property right of the petitioner. <br /> <br />That the granting of the exception will not be detrimental to the public welfare or <br />injurious to other property in the area in which the property is situated. <br /> <br />That the proposed exception will be harmonious with and in accordance with the <br />specific objectives of the City's existing Comprehensive Plan and will not <br />adversely affect the planning process for adoption of amendments to the <br />Comprehensive Plan above described. <br /> <br />That the proposed use/subdivision will be consistent with the intent and purpose <br />of this Ordinance. <br /> <br />SECTION 6. TERM <br /> <br />The term of this Ordinance shall be for a period of six months commencing with its effective <br />date. <br /> <br /> <br />
