Under Subdivision 1, amend "Owner" to read as follows: <br /> <br /> Dog Owner - shall mean the license holder or any other person or persons, firm, <br />association, or corporation owning, keeping or harboring a dog. Any person keeping or <br />harboring a dog for five consecutive days shall, for the purposes of this Section, be deemed an <br />owner. <br /> <br />Insert the following and renumber all subsequent subdivisions accordingly: <br /> <br /> Subd. 2. Number of Dogs Permitted. On a parcel or series of contiguous <br />parcels under the same ownership or occupancy as the dog owner, no more than two (2) dogs are <br />permitted. An administrative Kennel License may be obtained from the City to maintain three <br />(3) dogs on a property contingent upon payment of a fee in amount established by City Council <br />resolution and meeting the following criteria: <br /> <br />a. All dogs are cun'ently licensed by the City; <br /> <br />Appropriate measures, as determined by the City, have been taken to <br />prevent dogs from running at large; <br /> <br />Kennel structures (dog houses and/or fenced runs) are located at least 10 <br />feet from any abutting property line. Fenced yards shall not be considered <br />fenced runs. <br /> <br />do <br /> <br />An appropriate plan, as determined by the City, is in place for removal of <br />excrement fi'om the yard on a regular basis; <br /> <br />eo <br /> <br />No nuisance complaints have been received at the City within the previous <br />twenty-four (24) months relating to the dogs being kept on the property. <br /> <br />Administrative Kennel Licenses may be denied or revoked by the City Administrator or his/her <br />designee for cause including unsanitary facilities, keeping more dogs than the license authorizes, <br />keeping unlicensed dogs, allowing dogs to run at large or other nuisance complaints. Kennel <br />licenses expire two (2) years from the date of authorization. Biennial renewal applications are <br />due thirty (30) days before the expiration date. <br /> <br />A Conditional Use Permit is required for four (4) or more dogs. <br /> <br />Amend Subd. 3 "Licensing" to read as follows: <br /> <br /> Subd. 3. Licensing. All dogs kept, harbored, or maintained in the City shall <br />be licensed and registered. Applications for license shall be made to the Administrator upon <br />forms provided by the Administrator. Said application shall require the owner, among other <br />infornqation required by the Administrator, to supply the name, age, predominant breed, sex, <br />color and markings of each dog sought to be licensed. In addition, when the applicant or owner <br />has been convicted of violation of Subd. 16 relative to the dog sought to be licensed, the <br />application shall require proof of public liability insurance in the minimum amount of <br />$300,000.00.
