Wherever possible, placement of the sidewalk within the <br />easement area should allow for a minimum of one foot (1 ') separation between the <br />edge of one side and the residential property line. The sidewalk shall be <br />constructed as a Stage I improvement. Cost of sidewalk construction shall be borne <br />by the developer and not eligible for credit against park and trail dedication fees. <br />The design must meet current standards of the City, comply with the Americans for <br />Disabilities Act (ADA), and be shown on the preliminary plat for approval. <br /> <br />SECTION 3. MAINTENANCE <br /> <br />The City Council annually shall determine the level of snow removal required of adjacent <br />homeowners and to provide for the establishment of a fund to allow for repair or replacement of <br />damaged sidewalks in the future. <br /> <br />SECTION 4.
