PRINTER'S AFFIDAVIT OF PUBLICATION <br /> <br /> .. .ORDINANCE #O0-11 <br /> <br /> CITY OF RAMSEY ' <br /> ANOKA COUNTY' <br /> STATE OF MINNESOTA <br />VuAN AMENDMENT TO CHAPTER 9 <br />HICh IS KNOWN AS THE ZONING AND <br />RDIVISION OF LAND CHAP[ER OF THE <br />CITY CODE OF RAMSEY, MINNESOTA. <br /> AN ORDINANCE AMENDING SECTION <br /> 09.$0.S0 "CONSTRUCTION OF IMPROVE- <br /> MENTS'' OF CHAPTER 9 OF THE CITY CODE <br /> OF RAMSEY, MINNESOTA. <br /> The CRy of Ramsey ordains: <br /> SECTION 1. PURPOSE <br /> .~ 'The'intent of this ordinance is to provide <br /> direction for the placement of sidewalks in <br /> new urban residential developments. <br /> Sidewalks should be viewed as a necessary <br /> adjunct to residential development to meet the <br /> following .objectives: <br /> a) To promote public safety and welfare <br /> by separating pedestrian traffic from <br /> roadways in proximity to schools, <br /> churches, shopping facilities, and with- <br /> in residential developments. <br /> b)..To encourage pedestrian traffic as an <br /> alternative to short vehicular trips, <br /> thereby decreasing traffic, conserving <br /> energy, and promoting safety for resi- <br /> dents and children; <br /> c) To provide for linkage to the Park & <br /> Trail city trail system and encourage <br /> recreational use of the trails; <br /> d) To improve the pedestrian experience <br /> while promoting the use of landscap- <br /> ing such as boulevard trees and planti- <br /> ngs, thereby improving the visual <br /> aspects of our neighborhoods and <br /> property values. <br /> SECIION 2. AMENDMENT <br /> "Section 9.50.50 (Construction of <br /> Improvements), Subd. 2(a)(1) (Stage I <br /> r~provements) shall be amended to add the <br /> iJl'6Wing: <br /> (6) Sidewalks <br /> Section 9.50.50 (Construction of <br /> ]~rovements), Subd. 3(b) (Stage <br /> improvements) shall be amended to add the <br /> following: Sidewalks. All subdivisions within <br /> [he urban service area shall have not less than <br /> a five-foot (5') wide concrete sidewalk on at <br /> least one Side of each through street or antici- <br /> pated through street to provide for safe pedes- <br /> trian traffic. Sidewalks may be required on cul- <br /> de-sacs. All sidewalks shall be located within <br /> the easement area of the road right of way. <br /> Wherever. possible, placement of the sidewalk <br /> within the easement area should allow for a <br /> minimum of one foot (1') separation between <br /> the edge of one side and the residential prop- <br /> erty line. The sidewalk shall be constructed as <br /> a Stage I improvement. Cost of sidewalk con- <br /> struction shall be borne by the developer and <br /> not eligible for credit against park and trail <br /> dedication fees. The design must meet current <br /> standards of the City, comply with the <br /> Americans for Disabilities Act (ADA), and be <br /> shown on the preliminary plat for approval. <br /> SECTION 3. MAIN'I~NANCE <br /> The City Council annually shall determine <br /> the level of snow removal required of adjacent <br /> homeowners and to provide for the establish- <br /> ment of a fund.to allow for repair or replace= <br /> ment of damaged sidewalks in the future. <br /> SECTION 4. EFFECTIVE DATE <br /> This ordinance becomes effective upon its <br /> passage and thirty.
