4.6 System Maintenance. <br /> <br />4.7 <br /> <br />4.6.1 <br /> <br />The Grantee shall interrupt Service only for good cause and for the shortest time <br />possible. Such interruption shall occur during periods of minimum use of the <br />System. The Grantee shall use its best efforts to provide the City with at least <br />twenty-four (24) hours' prior notice of a planned service interruption, except for a <br />planned service interruption which will have a minimal impact on Subscribers, <br />usually meaning affecting less than one hundred (100) Subscribers or less than a <br />fifteen (15) minute interruption. <br /> <br />4.6.2 <br /> <br />Maintenance of the System shall be performed in accordance with the technical <br />performance and operating standards established by FCC rules and regulations. <br />Should the FCC choose to abandon this field and does not preempt the City's <br />entry into this field, the City may adopt such technical performance and operating <br />standards as its own, and the Grantee shall comply with them at all times. <br /> <br />System Tests and Inspections[ Special Testing. <br /> <br />4.7.1 <br /> <br />Grantee shall perform all tests necessary to demonstrate compliance with the <br />requirements of the Franchise and other performance standards established by law <br />or regulation. <br /> <br />4.7.2 <br /> <br />The City shall have the right to inspect all construction or installation work <br />performed pursuant to the provisions of this Franchise. In addition, the City may <br />require special testing of a location or locations within the System if there is a <br />particular matter of controversy or unresolved complaints regarding System <br />construction, operations or installation work pertaining to such location(s). Such <br />tests shall be limited to the particular matter in controversy. The City shall <br />endeavor to so arrange its request for such special testing so as to minimize <br />hardship or inconvenience to the Grantee or to the Subscribers of such testing. <br /> <br />4.7.3 <br /> <br />Before ordering such tests, the Grantee shall be afforded thirty (30) days <br />following receipt of written notice to investigate and, if necessary, correct <br />problems or complaints upon which tests were ordered. The City shall meet with <br />the Grantee prior to requiring special tests to discuss the need for such and, if <br />possible, visually inspect those locations which are the focus of concern. If, after <br />such meetings and inspections, the City wishes to commence special tests and the <br />thirty (30) days have elapsed without correction of the matter in controversy or <br />resolution of complaints, the tests shall be conducted at the Grantee's expense by <br />a qualified engineer selected by the City and the Grantee, and Grantee shall <br />cooperate in such testing. <br /> <br />4.7.4 <br /> <br />Unless otherwise provided in this Franchise, tests shall be supervised by the <br />Grantee's chief technical authority, who shall certify all records of tests provided <br />to the City. <br /> <br />24 <br /> <br /> <br />
