4.8 <br /> <br />4.9 <br /> <br />4.10 <br /> <br />4.11 <br /> <br />4.12 <br /> <br />4.13 <br /> <br />4.7.5 The Grantee shall provide the City with at least two (2) business days' prior <br /> written notice of, and opportunity to observe, any tests performed on the System. <br /> <br />4.7.6 Test results shall be filed with the City within fourteen (14) days of a written <br /> request by the City. <br /> <br />4.7.7 <br /> <br />If any test indicates that any part or component of the System fails to meet <br />applicable requirements, the Grantee, without requirement of additional notice or <br />request from the City, shall take corrective action, retest the locations and advise <br />the City of the action taken and the results achieved by filing a written report <br />certified by the Grantee's chief technical authority. <br /> <br />Drop Replacement. <br /> <br />The Grantee shall replace, at no separate charge to an individual Subscriber, all Drops <br />and/or associated passive equipment incapable of passing the full 870 MHz System <br />capacity at the time a Subscriber upgrades service to a level which requires a signal <br />above the 550 MHz spectrum. <br /> <br />FCC Reports. <br /> <br />Unless otherwise required by the terms of this Franchise, the results of any tests required <br />to be filed by Grantee with the FCC or in the Grantee's public file shall upon request of <br />the City also be filed with the City within ten (10) days of the request. <br /> <br />Nonvoice Return Capability. <br /> <br />Grantee is required to use cable and associated electronics having the technical capacity <br />for nonvoice return communications. <br /> <br />Lockout Device. <br /> <br />Upon the request of a Subscriber, the Grantee shall make a Lockout Device available at <br />no additional charge, other than a charge for a Converter. <br /> <br />Types of Service. <br /> <br />Should the Grantee desire to change the selection of programs or services offered on any <br />of its tiers, it shall maintain the mix, quality and level of services provided over the <br />System. Any change in programs or services offered shall comply with all lawful <br />conditions and procedures contained in this Franchise and in applicable law or <br />regulations. <br /> <br />Uses of System. <br /> <br />The Grantee shall, upon request of the Commission, advise the Commission of all active <br /> <br />25 <br /> <br /> <br />
