47 U.S.C. § 542. <br /> <br />SECTION 7. <br /> <br />INSTITUTIONAL NETWORK (I-NET) PROVISIONS <br /> <br />AND RELATED COMMITMENTS <br /> <br />7.1 Institutional Network Facilities and Capacity. <br /> <br />7.1.1 <br /> <br />The Grantee shall, at no cost to the City (and its agencies and departments), the <br />Commission and the institutions designated in Exhibit A to receive Institutional <br />Network service (collectively, the "I-Net Users"), construct, activate and maintain an <br />Institutional Network that consists of the following facilities: (i) six (6) bi- <br />directional fiber optic lines to each I-Net Node; and (ii) bi-directional coaxial cable <br />links between the sites designated in Exhibit A to receive Institutional Network <br />service (the "I-Net Sites") and the nearest I-Net Node. If a new City Hall facility is <br />constructed or established during the term of this Franchise, the Grantee shall <br />connect the new site to the Institutional Network, free of charge. The City (and its <br />departments and agencies), the Commission and all institutions located at the I-Net <br />Sites shall have exclusive use of all I-Net capacity, to the extent provided in <br />subsection 7.2. I-Net Users may not sell or resell services or capacity to any third <br />party. However, 1-Net Users may provide video, voice and data services to <br />themselves, including those which the Grantee otherwise sells to others. The <br />limitations of this paragraph shall not prevent I-Net Users from subleasing, bartering, <br />selling, reselling or giving away capacity on the Institutional Network to any other <br />public or nonprofit entity for noncommercial purposes that do not directly compete <br />with any products or services offered by the Grantee. <br /> <br />7.1.2 <br /> <br />The I-Net shall provide 450 MHz of activated capacity with no less than 54 standard <br />video (6 MHz) channels (at least 23 upstream channels and at least 31 downstream <br />channels) to the I-Net Sites. The entire I-Net shall be tested before the date of I-Net <br />activation. If any segment does not pass the Grantee's performance test(s), the <br />Grantee shall take all steps necessary to meet applicable standards, and the affected <br />segment shall be retested. At the Commission's request, the Grantee shall send the <br />Commission the results of each test conducted under this paragraph. <br /> <br />7.1.3 <br /> <br />All I-Net distribution system power supplies shall have the standby capability of <br />providing at least three (3) hours of backup power. Prior to battery failure, the <br />Grantee shall connect I-Net power supplies to portable generators capable of <br />producing adequate electrical current until commercial power is restored. <br /> <br />7.1.4 <br /> <br />The Grantee shall connect the I-Net Sites to the Institutional Network pursuant to <br />Exhibit A, at no cost to the City, the Commission or 1-Net Users. Other <br />governmental, public or educational institutions subsequently designated by the City <br />shall be connected to the I-Net via coaxial cable, free of charge, if the designated <br /> <br />36 <br /> <br /> <br />
