institution is located less than five hundred (500) feet from the existing I-Net, or if <br />such designated institution agrees to reimburse the Grantee for its Actual Costs in <br />excess of the cost of the first 500 feet of such installation. Notwithstanding the <br />foregoing, any new City Hall facilities shall be connected to the I-Net via coaxial <br />cable at no charge to the City, the Commission or any other I-Net Users. <br /> <br />7.1.5 <br /> <br />Notwithstanding anything to the contrary in this Franchise, the Grantee shall connect <br />the Ramsey Fire Department building located at 15050 Armstrong Boulevard, NW <br />(the "Ramsey Fire Hall") to the I-Net (the "Ramsey Fire Hall I-Net Connection"). In <br />accordance with this Franchise, the Ramsey Fire Hall I-Net Connection shall be <br />completed and successfully activated consistent with the diagram attached as Exhibit <br />C no later than December 31, 2002. If at the time of the I-Net upgrade the Ramsey <br />Fire Hall will continue to house the City's City Council chambers for a period of at <br />least twelve more months, the Grantee shall construct, equip and activate the Ramsey <br />Fire Hall I-Net Connection at no charge to the City, the Commission or other 1-Net <br />Users. However, if at the time of the I-Net Upgrade the City's City Council <br />chambers will continue to be housed in the Ramsey Fire Hall for less than twelve <br />months, the Commission or the appropriate I-Net User shall reimburse the Grantee <br />for its Actual Cost of installing the Ramsey Fire Hall I-Net Connection in excess of <br />the Actual Cost of the first 500 feet of construction from the existing Institutional <br />Network. Prior to the activation of the Ramsey Fire Hall I-Net Connection, the <br />Grantee shall provide the City with the following: (i) sufficient upstream bandwidth <br />on the subscriber network to transport a 6 MHz analog video channel to Grantee's <br />headend or hub, as appropriate; and (ii) all transmission equipment and materials <br />necessary to originate and transmit video signals from the Ramsey Fire Hall through <br />the Grantee's System to the City's discrete Governmental Access Channel <br />(collectively, the "Temporary Upstream Feed") and then on to Subscribers. The <br />Grantee shall complete and activate the Temporary Upstream Feed no later than the <br />Effective Date of this Franchise. The Temporary Upstream Feed shall remain fully <br />operational until such time as the Ramsey Fire Hall I-Net Connection passes all <br />applicable tests, as specified in subsection 7.1.2, and is successfully activated. At all <br />times, the combination of the downstream subscriber network and the Temporary <br />Upstream Feed or the Ramsey Fire Hall I-Net Connection shall meet or exceed FCC <br />technical standards at all Subscriber locations. The Grantee shall provide, install and <br />maintain the Temporary Upstream Feed at no charge to the City, the Commission or <br />I-Net Users. The Grantee may pass all direct costs associated with the Ramsey Fire <br />Hall I-Net Connection and the Temporary Upstream Feed through to all Subscribers <br />as an external cost and may itemize such costs on all Subscribers' monthly billing <br />statements as part of the PEG Fee or as a separate line item entitled "institutional <br />network," all in accordance with applicable law. <br /> <br />7.1.6 <br /> <br />I-Net Users shall be responsible for providing any end-user or interface equipment <br />needed for transmission or reception of signals. Notwithstanding the foregoing, the <br />Grantee shall, at the Commission's request, provide at no charge to the City, the <br />Commission or I-Net Users up to twenty (20) new modulators for City and/or <br />Commission use. <br /> <br />37 <br /> <br /> <br />
