1 3 0.0 5 1 5 RESTRICTIONS <br /> INVOLVING SALE TO <br /> MINORS <br />1. No person shall give, sell, procure or <br /> purchase an alcoholic beverage to or for <br /> any person to whom the sale of alcoholic <br /> beverage is forbidden by law; nor shall a <br /> licensee, or his agent or employee, <br /> permit such person to be furnished or <br /> consume any such alcoholic beverage on <br /> the licensed premises. <br />2. No person under twenty-one (21) years <br /> of age shall misrepresent his age for the <br /> purpose of obtaining intoxicating liquor <br /> nor shall such person enter any <br /> premises licensed for the retail sale of <br /> an alcoholic beverage for the purpose of <br /> purchasing or having served or <br /> delivered to such person for consuming <br /> any such alcoholic beverage, nor shall <br /> any person purchase, attempt to <br /> purchase, consume, or have another <br /> person purchase for on that person's <br /> behalf any alcoholic beverage. <br />3. No person under twenty-one (21) years <br /> of age shall receive delivery of an <br /> alcoholic beverage. <br />4. No person shall induce a person under <br /> the age of twenty-one (21) years to <br /> purchase or procure or obtain an <br /> alcoholic beverage. <br />5. Any person who may appear to the <br /> licensee, the licensee's employees or <br /> agents, to be under the age of twenty-one <br /> (21) shall, upon demand of the licensee, <br /> an employee or agent, produce and permit <br /> to be examined an identification <br /> certificate issued by any Administrator <br /> of District Court in the State of <br /> Minnesota pursuant to Section 626.311 <br /> through 626.319, Minnesota Statutes. <br />6. In every prosecution for a violation of <br /> the provisions of this ordinance relating <br /> to the sale or furnishing of alcoholic <br /> beverage to persons under the age of <br /> twenty-one (21) years, and in every <br /> proceeding before the City Council with <br /> respect thereto, the fact that the minor <br /> involved has obtained and presented to <br /> <br />the licensee, an employee or agent, a <br />verified identification card issued by the <br />Clerk of District Court in the State of <br />Minnesota, from which it appears that <br />said person was twenty-one (21) years <br />of age and was regularly issued such <br />identification card, shall be prima facie <br />evidence that the licensee, the agent or <br />employee is not guilty of a violation of <br />such a provision and shall be conclusive <br />evidence that a violation, if one has <br />occurred, was not willful or intentional. <br />Proof of age for purchasing and <br />consuming alcoholic beverages may be <br />established only by a valid state driver's <br />license or state identification card; or in <br />the case of a forign national by a valid <br />passport. <br /> <br />1 3 0.0 5 1 6 OTHER RESTRICTIONS <br /> ON PURCHASE OR <br /> CONSUMPTION <br />1. No person shall give, sell, procure or <br /> purchase alcoholic beverage for any <br /> person to whom the sale of alcoholic <br /> beverage is forbidden by State law or <br /> this ordinance. <br />2. No person shall mix or prepare alcoholic <br /> beverage for "on sale" consumption in <br /> any public place not licensed in <br /> accordance with this code and the laws of <br /> the State of Minnesota. <br /> <br />I 3 0.0 5 1 7 REVOCATION <br />1. The City Council may suspend or revoke <br /> an "on sale" license for the violation of <br /> any provision or condition of this <br /> chapter or of any state law or federal law <br /> regulating alcoholic beverage and shall <br /> revoke such license for any willful <br /> violation which, under the laws of the <br /> state, is grounds for mandatory <br /> revocation, and shall revoke for failure <br /> to keep the insurance required by this <br /> chapter in full force and effect. <br />2. If the premises are not ready for <br /> occupancy within one year after the <br /> initial license is issued, the license shall <br /> be revoked and will not be reissued. The <br /> <br /> <br />
