Possession on the premises by the licensee of any alcoholic beverage in the original package differing in the composition or alcoholic content in the liquor when received from the manufacturer or wholesaler from whom it was purchased shall be prima facie evidence that the contents of the original package has been diluted, changed or tampered with. No sale of alcoholic beverage shall be made to or in guest rooms of hotels, unless the rules of such hotels provide for the service of food in guest rooms; nor unless the sale of such alcoholic beverage is made in the manner "on sale" are required to be made; nor unless such sale accompanies and is incident to the regular service of meals to guests therein; nor unless the rules of such hotel and the description, location and number of such guest rooms are fully set out in the application for a license. No transfer of a license shall be permitted from place to place or person to person without complying with the requirements of an original application, except as provided by Section 130.058(8) and each transfer shall require the approval of the City Council and the Liquor Control Commissioner. I 30.05 1 3 FINANCIAL RESPONSIBILITY AND INSURANCE Compliance with financial responsibility requirements of State law and of this ordinance is a continuing condition of any license granted pursuant to this ordinance. 1 30.05 1 4 HOURS OF OPERATION 1. No sale of intoxicating liquor for consumption on the licensed premises may be made: a. between 1:00 a.m. and 8:00 a.m. on the days of Tuesday through Saturday; b. between 12:00 midnight and 8:00 a.m. on Mondays; c. after 1:00 a.m. on Sundays, except as provided by subdivision 3; d. between 8:00 p.m. on December 24 and 8:00 a.m. on December 25, except as provided by subdivision 3. Special Sunday "on sale" liquor licenses. Hotels, restaurants, clubs, and bowling centers (as per State law) having special Sunday "on sale" liquor licenses may serve alcoholic beverages in conjunction with the sale of food between the hours of 10:00 a.m. and 12:00 midnight on Sunday, provided the licensee is in conformance with the Minnesota Clean Air Act, notwithstanding the provisions of Paragraph 1 above. Except as otherwise herein provided, all "on sale" establishments, bottle clubs and public drinking places shall be closed to the public not later than one-half (1/2) hour after the required time for stopping sales, until the time herein provided as permissible for sales, consumption or display. No persons other than employees shall be permitted within such establishments during the closed periods. All such "on sale" licensees may keep licensed premises open at times when the sale of intoxicating and non-alcoholic beverage is prohibited for sale of food or recreational activity, provided such licensees shall lock, or in other manner secure, all facilities or equipment for the serving of such liquor starting not later than 1:00 a.m. until the time herein provided as permissible for sales, consumption or display. All public entrances to premises open after 1:00 a.m. shall remain open and unlocked during all times when said premises have customers therein. No licensee who elects to remain open after 1:00 a.m. shall permit any person to consume or display any liquor in any container, including glasses, in the premises after 1:30 a.m. and until the time herein provided as permissible for sales, consumption or display.
