19. <br /> <br />20. <br /> <br />content while in the original package. <br />Possession on the premises by the <br />licensee of any alcoholic beverage in the <br />original package differing in the <br />composition or alcoholic content in the <br />liquor when received from the <br />manufacturer or wholesaler from whom <br />it was purchased shall be prima facie <br />evidence that the contents of the original <br />package has been diluted, changed or <br />tampered with. <br />No sale of alcoholic beverage shall be <br />made to or in guest rooms of hotels, <br />unless the rules of such hotels provide <br />for the service of food in guest rooms; <br />nor unless the sale of such alcoholic <br />beverage is made in the manner "on sale" <br />are required to be made; nor unless such <br />sale accompanies and is incident to the <br />regular service of meals to guests <br />therein; nor unless the rules of such <br />hotel and the description, location and <br />number of such guest rooms are fully set <br />out in the application for a license. <br />No transfer of a license shall be <br />permitted from place to place or person <br />to person without complying with the <br />requirements of an original application, <br />except as provided by Section <br />130.058(8) and each transfer shall <br />require the approval of the City Council <br />and the Liquor Control Commissioner. <br /> <br />I 30.05 1 3 FINANCIAL <br /> RESPONSIBILITY AND <br /> INSURANCE <br /> Compliance with financial responsibility <br /> requirements of State law and of this <br /> ordinance is a continuing condition of any <br /> license granted pursuant to this ordinance. <br /> <br />1 30.05 1 4 HOURS OF OPERATION <br />1. No sale of intoxicating liquor for <br /> consumption on the licensed premises <br /> may be made: <br /> a. between 1:00 a.m. and 8:00 a.m. on <br /> the days of Tuesday through Saturday; <br /> b. between 12:00 midnight and 8:00 <br /> a.m. on Mondays; <br /> <br />c. after 1:00 a.m. on Sundays, except as <br />provided by subdivision 3; <br />d. between 8:00 p.m. on December 24 <br /> and 8:00 a.m. on December 25, except <br /> as provided by subdivision 3. <br />Special Sunday "on sale" liquor licenses. <br />Hotels, restaurants, clubs, and bowling <br />centers (as per State law) having special <br />Sunday "on sale" liquor licenses may <br />serve alcoholic beverages in conjunction <br />with the sale of food between the hours of <br />10:00 a.m. and 12:00 midnight on <br />Sunday, provided the licensee is in <br />conformance with the Minnesota Clean <br />Air Act, notwithstanding the provisions <br />of Paragraph 1 above. <br />Except as otherwise herein provided, all <br />"on sale" establishments, bottle clubs <br />and public drinking places shall be <br />closed to the public not later than <br />one-half (1/2) hour after the required <br />time for stopping sales, until the time <br />herein provided as permissible for <br />sales, consumption or display. No <br />persons other than employees shall be <br />permitted within such establishments <br />during the closed periods. All such "on <br />sale" licensees may keep licensed <br />premises open at times when the sale of <br />intoxicating and non-alcoholic beverage <br />is prohibited for sale of food or <br />recreational activity, provided such <br />licensees shall lock, or in other manner <br />secure, all facilities or equipment for <br />the serving of such liquor starting not <br />later than 1:00 a.m. until the time <br />herein provided as permissible for <br />sales, consumption or display. All public <br />entrances to premises open after 1:00 <br />a.m. shall remain open and unlocked <br />during all times when said premises <br />have customers therein. No licensee who <br />elects to remain open after 1:00 a.m. <br />shall permit any person to consume or <br />display any liquor in any container, <br />including glasses, in the premises after <br />1:30 a.m. and until the time herein <br />provided as permissible for sales, <br />consumption or display. <br /> <br /> <br />
