Ce <br /> <br />inconvenience to adjacent or nearby property, and to <br />assure that proper care is taken in stock piling <br />excavated material in order to avoid erosion, dust, or <br />other infringement onto adjacent property. <br /> <br />Setback requirements. <br /> <br />A Swimming Pool or Spa may not be located within any <br />rear, front or side yard setback as prescribed for <br />the zoning district in which the parcel is located. <br /> <br />ii. <br /> <br />A Swimming Pool or Spa may not be located closer <br />than four (4) feet to the principal structure <br />located on the parcel where the Swimming Pool or Spa <br />is to be constructed. A Swimming Pool or Spa may <br />not extend closer to the front lot line of the <br />parcel than the principal structure located on said <br />parcel, except that on residential parcels of one <br />acre or more in size, a Swimming Pool or Spa may be <br />constructed closer to the front lot line than the <br />principal structure, provided, that such swinu~ing <br />Pool or Spa is constructed within the minimum <br />setback of two hundred (200) feet. <br /> <br />iii. No Swimming Pool or Spa may be constructed within <br /> twenty (20) feet of any portion of an on-site sewer <br /> system or any private water well. <br /> <br />Fencing. <br /> <br />Temporary fencing. During the construction of any <br />in-ground Swimming Pool or Spa, the construction <br />area must be secured with a portable fence which is <br />not less than four (4) feet in height. <br /> <br />ii. <br /> <br />Permanent fencing. All Outdoor swimming Pools must <br />be completely enclosed by a permanent fence or wall <br />of a non-climbing type which has no external <br />handholds or footholds, so as to be impenetrable by <br />toddlers. The entire enclosure must be at least <br />four (4) feet in height. The opening between the <br />bottom of the fence and the ground or other surface <br />shall be not more than three (3) inches. Ail <br />outdoor fence or wall openings or outdoor points of <br />entry into the pool area shall be equipped with <br />self-closing and self-latching devices. <br /> <br />iii. Above ground Swimming Pools. All above-ground <br /> Swimming Pools that have a minimum side-wall height <br /> of four (4) feet need not be fenced, but shall have <br /> removable steps, which steps shall be removed when <br /> the Swimming Pool is unattended.
