<br /> The city Of Ramgey ordains:
<br /> ·; SECTION 10.8J
<br /> THE.BOARD OF ApPEALs
<br /> Section 10.81.t. Creation. The, Ramsey ·Build-
<br /> ing Code Board of Appeals is. created pursuant
<br /> to Section 204 of t;~e Building Code of the City of
<br /> Rar~sey adopted by Ramsey Code of Ordi-
<br /> nances, Section 150, and is hereinafter referred
<br /> to as'the,' Boa rdt'.
<br /> Section J0.81.2~-Membership. The Board is
<br /> composed of five (5) members appointed by the
<br /> Mayor end approved by the City Council. The
<br /> Community Development Director and the
<br /> Building Official serve as ex-officio members·
<br /> Section 10.81.3. Office of the Board and Place
<br /> of M~eeting. The office of the Board shall be at
<br /> the Ramsey Municipal Center, 15153 Nowthen
<br /> Blvd. 'N.W,, Ramsey, Minnesota, or at such
<br /> Other.' @lace as the Board may designate. All
<br /> meetings of the Board shaB be held at such of-
<br /> fice e~cept that on three (3) days written notice
<br /> to all B.0ard members and to any person or per-
<br /> sons.whose appeal isto be heard at that time.
<br /> AhY regular or special rfleeting of the Board
<br /> m,3y b,e held at such other place within Ramsey
<br />· as the notice may designele..
<br /> · SeCtion 10.81.4. Rues of Procedure. All pro-
<br /> ceedings of the Board shall be governed by the
<br /> Rules of Procedure hereinafter set forth and by
<br /> the provisions of the Ramsey Building Code.
<br /> Any conflict between these ,Rules of Procedure
<br /> and the Ramsey Building.Codershall be resolv-
<br /> ed by ~he provisions of the Ramsey Building
<br />
<br /> Section 10.81.5.. Compensation. /v~embers of
<br /> the Board shall be.compensated $20.00 per
<br />r meeti,ng (or expenses incurred.
<br />
<br /> , '- OFFICERS OF THE BOARD
<br />; SeCtiOh i0.82.1~ Officers...The officers of the
<br /> Boardshall consist of a chairperson and vice-
<br />/chairpe?son. The Building Official, an ex-officio
<br />i. member of'the Board, shall act as secretary of
<br /> the Boa~d.;
<br />L. SeC:tl011'!0.02.2. Election of Officers; .At the
<br /> Annual. Meeting, the Board shall elect a
<br /> chairpd~'so/l~and Vice ch.a rporson from among
<br />': its members who.shall hold their re~Pe~:tive of:
<br />' rices.until the next Annual /V~eenng and until
<br />:,: their successors are ~lect'ed.
<br /> $ectienl 1,0 82.31 Chairperson. The chairperson
<br />~ shall presideat,aU meetings of the Board.
<br />Section 10.82.4. Vice-Chairperson. The. vice-~
<br />chairperson shall act i~ the absence of the
<br />· chairperson and shall Perform Ihe.dUties of the
<br />~ chairperson whenever the ch~irporson has
<br />' resigned or iS incapacitated and. until a new
<br />'; chairpersonise ected
<br /> S~ction 10.02.5. Secretary[ The'secretary shall
<br />- keep a true and complete record of the Pro-
<br />ceedings of the Board and shall, at the discre~
<br />· lien of the Board, prepare,all notices, reports,
<br />' written decisions, recommendations, and such
<br />~ other writings as the Board may direct.
<br />~ ' ' SECTION 10,83 f .
<br />!. · MEETINGS
<br />r..Section 10.83.1 Annual Meeting., The Annual
<br /> Meeting:of the Board shall be held each year on
<br /> the second Monday in January.
<br /> Section 10.83.:t. Regular Meeting. Regular
<br />r
<br />'~ meetings of the Board shall be held on notice
<br />~ from the segretary within ten (10) wor~ing d'ays
<br />. after an a~peal is filed with the Board· If addi-
<br /> tional time is. re'guided, ~?i ext~e~nsion:to'the ten
<br /> (10) working days.may be granted. , with ap-
<br /> proval Of l~le ~h~ii;~'person.
<br /> Section ,)0.$3.3 Special Meeting. Special
<br /> meet!ngs- of :the Board.re.ay !~e .called by the
<br /> chairperson, ,vice-chairperson, or any~
<br /> membmZs of the Board by written notice filed
<br /> with thi~ secretary who shall notify all members
<br /> of the time and place of a special meeting as
<br /> hereinafter provided.
<br /> Section 10.03.4. Adjourned Meeting. Any
<br /> meeting of the Board may be adjourned from
<br /> time to time to a specified time without addi-
<br /> tional notice .except that members not then in
<br /> attendance shall be notified of the adiourned
<br /> meeting.
<br /> Section 10.03.5. Notices. Notices in writing
<br />specifying the time and place lot the Annual
<br />Meeting shall be sent to all members~ All per-
<br />sons who have filed appeals to be heard by the
<br />Board shall be notified of the regular meeting
<br />at which the hearing shall be held, and all
<br />~nembers of the Board shall be notified of ragu-
<br />· lar and special meetings. Notices for regular
<br />and special rffeetings shall be given by. such
<br />means (maii, personal service or telephone) as
<br />will provide for notification at least three ~(3)
<br />working days in advance of the meeting.'
<br /> · SECTIQN 10.84
<br /> ~UORUM AND VOTE
<br /> ' Section 10.04.1 Quorum. Three-members of
<br />
<br />Building Code for which an interpretation is re-
<br />quested. ~ -
<br /> An applicant who is dissatisfied with an in-
<br />terpretation of the Building Official may there-
<br />upon appeal to the Board as hereinafter provid~
<br />ed.
<br /> Section 10.86.4. Appeals. Any person who is
<br />dissatisfied with an interpretation or decision at
<br />the Building Off. icial rendered in response to an
<br />application therefore may appeal to the Board
<br />for its review and decision: An appeal ah'aU, be
<br />in writing ~nd shall include a reference
<br />particular application jn response to which'the
<br />inte'rpreta/ion or decision being appealed was
<br />rendered.
<br /> No appeal shall be taken to the Board unless
<br />the applicant has first made application to the
<br />Building Official as provided in these Rule~.
<br /> SECTION 10.87
<br /> HEARINGS :
<br /> Section 10.87.1. Malters to be Heard. A hear-
<br />ing shall be held on all matters coming before
<br />
<br /> and including Friday, the ................ day of

<br />gra~ted, with the approval of the applica'nt. If
<br />an appeal is determined to be insufficient Under
<br />these Rules, the Building Official shall Im-
<br />mediately notify the applicant of such idSuffi-
<br />ciency and the same shall not be Scheduled for
<br />hearing until made complete and sufficient by
<br />the applicant. "-
<br /> Section 10.87.3. Procedure at HearingsL A
<br />hearing on an appeal shall be Conducted in the
<br />following manner: ' ~
<br /> (ii The. appeal shall be read alou~l by'the
<br />secretary.
<br /> (ii) The applicant or his representative
<br />shall be heard.
<br /> (iii) The Building Official and any employees
<br />of his/her department desiring to speak On-the
<br />matter shall be heard, r : :
<br /> (iv) ~Anyone else desiring to speak in' sup-
<br />port of an appeal shall be heard.
<br /> (v) Anyone else desiring to speak against
<br />an appeal shall be heard~ . '
<br /> Sect on 10.87.4. Action al Board~ After' conclu-
<br />sion of a hearing on an appeal, the Board shall
<br />then' act on the matter or it shall take the mat-
<br />
<br /> after as practicable. : ' ;">
<br />
<br />ACTION OF BOARD ON APPEAL
<br />Section 10.88.1. Form. Every final decision of
<br />the Board on an appeal shall be in writir!g, shall
<br />contain f,injdings of the Board, shall be signed by
<br />the chairperson, and shall contain the /'off ·call
<br />vote of the members of the Board. ' '"
<br /> Section 10.80.2. Appeal Involving a Variance
<br />in New Construction. In the case of an ap~/ea!
<br />from a decision of the Building Official tO grant
<br />a variance in new construction, no variance
<br />from the provisions:of the Buildirig Code'shall
<br />be approved bY the Board unless it is deter[bin-
<br />ed by the Board that .the proposed Variar~ce is
<br />equal to Or better than the mode of construction
<br />or the materials required by the Building C6d, e.
<br /> Section 10.88.3. Other Appeals. In the case of
<br />,shy other appeal, the Board may affirm, dr it
<br />may reverse or modify the action of the Bt~'ild-
<br />lng Official. If the Board acts to reverse, or
<br />modify the interpretation or decis!on of ]the
<br />Building Official, it shall do so only upon a
<br />determination that:

<br /> Section 10.86.3 Application for Interpretation
<br /> of the Building Code. Any person who desires an ed with all of the requirements constituting qualification
<br /> interpretation of the Building Code shall first)vialed by Minnesota Statute 331A.02, 331A.07, and other
<br /> submit a written request for an interpretation
<br /> to the Building Official. Such request shall in-
<br /> clude:
<br /> (i) The name and address of the applicant,
<br /> and if the applicant is acting as agent rfor ...................................................
