- 5 - <br /> <br />a dangerous dog is being harbored or cared for in <br />violation of SubSections (1), (Z), (3), and (4) <br />above, the police officer or animal control officer <br />may petition a court of competent jurisdiction ko <br />order the seizure and impoundment of the dangerous <br />dog pending trial. In the event that a police <br />officer or animal control officer has probable <br />cause to believe that a dangerous dog is being <br />harbored or housed in violation of Section (3) <br />above, the police officer or animal control offier <br />may seize and impound the dangerous dog pending <br />trial. <br /> <br />110.0316 Failure to Restrain an attack by a Dog. It shall be <br />unlawful for an owner to fail to restrain a dog from <br />inflicting or attempting to inflict bodily injury to any <br />person or other animal. Violation of this section shall be a <br />misdemeanor. The Court upon a finding of the defendant's <br />guilt hereunder, is authorized to order, as part of the <br />disposition of the case, that the animal be destroyed based <br />on a written order containing one or more of She following <br />findings of fact: <br /> <br />The animal is dangerous as demonstrated by a vicious <br />attack, an unprovoked a'Ctack, an attack without warning, <br />or multiple attacks; or <br /> <br />The owner of the animal has demonstrated an inability <br />or unwillingness to control the animal in order to <br />prevent injury to persons or other animal. <br /> <br />If the Court does not order the destruction of the dog, the <br />Court, as an alternative, may order the defendant to provide, <br />and show proof to the Court of public liability insurance in <br />the minimum amount of $300,000.00· <br /> <br />110.0317 stoppin, g. an Attack. If any Police Officer or Ani~aal <br />Control Officer ~s"witness to an attack by a dog upon a <br />person or another animal, the officer may take whatever means <br />he or she deems appropriate to bring the attack to an end and <br />prevent further injury to ~he victim. <br /> <br />110.0318 Uogs Disturbing the Peace. It shall be unlawful for <br />any person to own, keep, have in possession, or harbor any <br />dog which howls, yelps, or barks to ~he reasonable annoyance <br />of another person or persons. Any person viola~in§ this <br />section, who upon first requested by a Police Officer or <br />Animal Control Officer to stop or prevent the annoyance, and <br />refuses to comply with the request will be issued a citation <br />or arrested in accordance with iqinnesota Rules of Criminal <br />Procedure, and, if the officer deems it necessary to stop the <br />annoyance, may have the dog -:aken ~o the City animal pound. <br />Any dog placed in the oound ~-~ay be reclai~ed by the owner <br />upon payment of the fee presecribed in Section 110.039, and <br /> <br /> <br />
