<br /> - SECTION 110. . 'DEFINITIONS. The fol-
<br />Oeing words and phrases, when used in this
<br />inance, unless the c~ntext clearly indicates
<br />rwlse, shall have the meanings ascribed to
<br />them in this section.
<br /> Subd. 1 "Aluminum Recyclables" shall be
<br /> 'dee~rfie~t to 'include aluminum foil and all
<br /> disposable containers fabricated primarily of
<br /> alu-ri'ii,h'm add commonly used for soda, beer
<br /> or other beverages. ' . -.
<br /> Subd. 2 "Collection" means the aggregation
<br /> of waste from the place at which it is generated
<br /> ~and includes all activities tip to the time when
<br /> the waste is delivered to a "waste facility".
<br /> Subd,' 3 "Collector(~)" mdan~ any person(s)
<br /> whb owns, operates or leases vehicles for the
<br /> purposes'of collection and lransportation of any

<br /> e) Nothing in this Ordinance shall abridge the
<br />right of any authorized recycling program to
<br />lawfully operate within the City,'sub[ect to such
<br />other licenses or other regulations as 'may be
<br />required by law.
<br /> f) Effective December S, 1988 it is unlawful
<br />for a person to collect, remove, dispose or in-
<br />cinerate recyclable materials as are specified
<br />by ordinance in this City in a manner, inconsis-
<br />tent with rules, regulations or procedures
<br />adopted by the City.
<br /> SECTION . LICENSING OF COLLEC-
<br />TION, HAULIN~ OR CONVEYING
<br /> RECYCLABLE MATERIALS
<br /> Subd. 1. License Required. No person, firm or
<br />corporation shall engage in a commercial
<br />business of collecting, hauling or conveying
<br />recyclable materials in the City unless a license
<br />is secured therefore as provided in this ordi-
<br />nance.
<br />' Subd. 2. Application for License. Application
<br />for such license to collect, haul or convey
<br />recyclable materials in the City shall be in writ-
<br />ing, shall be filed with the City Adminislrator
<br />and shall state the name and address of the ap-
<br />plicant, the types and makes of equipment to be
<br />used, a schedule of charges for the performance
<br />of said services, and full information as to
<br />where and how such material shall be disposed
<br />of. Said application shall also be accompanied
<br />by the license fee hereafter provided and by a
<br />gOOd and sufficient policy of insurance whereby
<br />each vehicle to be used by said applicant shall
<br />be covered against loss or injury in the follow-
<br />ing amounts: each person injured, at least Fit-
<br />ly Thousand Dollars ($50,000); each accident, at
<br />least One Hundred Thousand Dollars ($100,000)
<br />for loss or damage to property. Such Insurance
<br />policy shall provide for the giving of lhirty (30)
<br />days prior notice to the City of the termination
<br />or cancellation of said policy. .
<br /> Subd. 3. License Fee. The annual license fee
<br />for such license shall be established by resolu-
<br />tion of the City Council from time to time.
<br /> Subd. 4. Term and Issuance of License. All
<br />licenses shall expire on the 31st day of
<br />December of the effective year. Licenses first
<br />issued in tile fourth quarter of a calendar year
<br />shall be effective ,through December 31 of the
<br />following year. Applications for licenses shall
<br />be considered by the City Council and, if ap-
<br />proved by the City Council, a license shall be
<br />issued by the City Administrator. Licenses shall
<br />not be transferable from one person, firm, or
<br />corporation to another person, firm, or corpora-
<br />tion. License fees paid to renew an expired
<br />license shall be paid on or before December 1st
<br />of the year preceding the effective year. Any
<br />annual fee paid later than five (5) working days
<br />'after December 1st is subject to an additional
<br />administrative service charge.
<br />
<br /> Subd. 5. Equipment ~f Collector. Each licens-
<br />ed collector shall provide a covered truck, se
<br />constructed that the contents will not leak or
<br />spill therefrom, in which all material collected
<br />by him shall be conveyed to the place desig-
<br />nated in his application. The conveyance used
<br />shall be kept clean and as. free from offensive
<br />odors as possible, and shall not be allowed to
<br />stand in any street, alley or public place longer
<br />than is reasonably necessary to perform collec-
<br />tion.
<br /> Subd. 6. Recyclable Material~ Collections.
<br />Collections of recyclable materials shall be
<br />made under such terms and at such times and
<br />frequencies as shall be designated from time to
<br />time by the City Council.
<br /> Subd. 7. Ultimate Disposition of Recyclables.
<br />Licensed collectors must certify that materials
<br />collected for recycling are delivered to facilities
<br />which reprocess the collected materials into
<br />recycled products. Licensed collectors shall
<br />submit weight slip receipts on a monthly basis
<br />to the City for ali recyclables.

<br /> SECTION . NOTIFICATION OF RESI-
<br />DENTS OF RECYCLING PROGRAM.
<br /> The City of Ramsey shall within six months of
<br />the effective date of this ordinance and at least
<br />once every six months thereafter notify all per-
<br />sons occupying residential, commercial and in-
<br />stitutional premises within its municipal
<br />boundaries of local recycling opportunities and
<br />the source separation requirements of this ordi-
<br />nance.
<br /> In order to fulfill the notification require-
<br />ments of this subsection, the City of Ramsay
<br />may, in Its discretion, place an advertisement
<br />in a newspaper, post a notice In public places
<br />where public notices are customarily posted,
<br />include a notice with other official notifications
<br />periodically mailed to residential taxpayers, or
<br />any combination thereof, as the City deems
<br />necessary and appropriate.
<br />SECTION . VIO~.ATION AND PENALTY.
<br />Subd. 1. It is unlawful for any licensed collec-
<br />tor to collect recyclable materials and fall to
<br />deliver or transfer the materials to bonaflde
<br />processors or their agents for reprocessing Into
<br />recycled products.
<br /> Subd. 2. Any licensed collector found In violet-
<br />ion of Section --, subd. 3 shall be guilty of a
<br />misdemeanor for each occurrence and upon
<br />conviction shall be punished as provided for by
<br />City Ordinance Section .
<br /> SECTION . ENFORCEMENT. It Is the
<br />duty of the Code Enforcement Officer to enforce
<br />the provisions of this ordinance.
<br /> SECTION . SEVERABILITY. II Is hereby
<br />declared to be the Intention.of the City that Ihe
<br />several provisions of this ordinance are
<br />severable in accordance with the following:
<br /> Subd. 1. If any court of competent lurlsdictlon
<br />shall adjudge any provision of this ordinance to
<br />be invalid, such judgment shall not affect any
<br />other provision of this ordinance not specifically
<br />included in said ludgment.
<br /> SECTION --. PROVISIONS ARE AC-
<br />CUMULATIVE. The provisions of this Ordi-
<br />nance are accumulative to all other laws, ordi-
<br />nances .and .regulations heretofore passed~ or
<br />which may'be passed hereafter, ~:overlng any
<br />subject matter in this Ordinance.
<br /> SECTION , EFFECTIVE DATE. This or-
<br />dinance becomes effective upon Its passage and
<br />publication according to law. Passed by the Ci-
<br />ty Council of Ramsey, Minnesota this 25th day
