between a residence and any part of the site where landfill activity is proposed to <br />take place. <br /> <br />Co <br /> <br />Suitable berms, barriers and vegetation shall screen the landfill activity area year <br />'round from property within one mile of the landfill site. Solid waste may not be <br />used as berming material. Screening shall provide a minimum of 90% opacity year <br />'round. <br /> <br />8. HEIGHT LIMITATION ON LANDFILL ACTIVITY. <br /> <br />The height of a landfill becomes a scenic blight and nuisance when the landfill activity rises above <br />any natural or man made screening. Therefore, landfills may not exceed the height of the lowest <br />berm, barrier or vegetation surrounding the landf'fll site. <br /> <br />9. REQUIRED PRACTICES FOR MAINTENANCE AND OPERATION AND <br /> LANDFILLS. <br /> <br />Solid waste landfills shall be operated and maintained in accordance with the rules promulgated by <br />the commissioner of the MPCA and in compliance with Section V of Anoka County Ordinance 83- <br />3 as may be amended from time to time except as modified or amended herein. <br /> <br />ao <br /> <br />Visual screening shall be accomplished as provided in Subsections 7 and 8 of this <br />ordinance. <br /> <br />b0 <br /> <br />A minimum separation distance of 1000' is required between a residence and where <br />landfill construction activity is proposed to take place. <br /> <br />Co <br /> <br />No solid waste disposal facility shall be opened for use and shall not receive solid <br />waste deposits before 7:00 a.m. or after 6:00 p.m. Monday through Friday and <br />before 7:00 a.m. or after 2:00 p.m. on Saturdays. No operations are permitted on <br />Sundays. No equipment operation shall commence before 6:30 a.m. or continue <br />longer than one hour after the daily closing time of the landfill as herein specified. <br />All solid waste deposits shall be covered within these time limits on the day <br />received. <br /> <br />10. TIME LIMITATION. <br /> <br />No conditional use permits or permit renewals for a solid waste disposal facility shall be granted <br />for a period exceeding five (5) years from the date of issuance of the initial Conditional Use <br />Permit. The applicant shall agree to the limitations provided in this Section by contract duly <br />executed by authorized representatives of the applicant in a form satisfactory to the City Council. <br /> <br />1 1. CRITERIA FOR LANDFILLS. <br /> <br />Land disposal facilities shall be located, designed and operated in such a way as to prevent any <br />adverse impact upon adjacent land uses. In addition to the criteria listed in Section 170.013D of <br />the City Code, the following criteria shall be considered when evaluating a request for a conditional <br />use permit for landfills. <br /> <br />a) <br /> <br />Whether the proposed landfill will be in compliance with the Anoka County Solid <br />Waste Management Master Plan, Metropolitan Council's Guide/Policy Plan and <br />MPCA rules. <br /> <br />b) Whether the proposed landfill is accessible year-round by nine-ton or greater weight- <br /> <br /> <br />
