Performance contract. Prior to the installation of any <br />required i~npr~vements by a subdivider and prior to Council approval of the final plat, the <br />subdividqr shall enter into a contract with the City, which contract shall require the <br />subdivid~ to', construct said improvements at the sole expense of the subdivider and in <br />accordance with City approved constructions plans and sPecifications and all applicable <br />City standards and ordinances. Said contract shall provide for the supervision of the <br />constructibn IJY the City Engineer and shall require that the City be reimbursed for all costs <br />incurred by tl!,e City for engineering and legal fees and other expenses in connection with <br />the makin~ of such improvements. The performance of said contract shall be financially <br />secured bY a cash escrow deposit or financial surety as hereinafter set forth. No <br />performance COntract or financial security shall be required for any improvement which is <br />not a reqt~ire~ent for approval of the final plat. The contract shall also provide that the <br />subdivide~r give a one year warranty and guarantee to the City from date of acceptance by <br />the City o~ all improvements constructed on behalf of or dedicated to the City. <br /> Subd. 8. Construction Plans (All Development Areas). <br />Construct$on plans and specification for the required improvements conforming in all <br />respects With the code and ordinances of the City shall be prepared at the expense of the <br />subdivid~ by a professional engineer registered by the State of Minnesota. Such plans and <br />specificat !ons shall be approved by the City Engineer and shall become a part of the <br />perfonm ice Contract. Two prints of said plans and specifications shall be filed with the <br />City AdmJ nisti'ator or designated representative. <br /> <br /> Subd.9. Inspection (All Development Areas). All required <br />improvem ~ntsl shall be inspected during the course of construction by the City Engineer and <br />acceptanc~ of ~aid improvements by the City shah requke the prior written certification by <br />the City E agineer that said improvements have been constructed in compliance with the <br />plans and !Ipeeifications. <br /> , Subd. 10. Prior Improvements. Improvements which have been <br />completed prior to application for final plat approval or execution of the performance <br />contract sltall ~be accepted as equivalent improvements provided the City Engineer shall <br />certify in Writing that all said improvements conform to City standards. <br /> <br /> ~Subd.ll. Construction by City. The City shall have the right to <br />install suOh of the required improvements as it may elect and upon such terms and <br />conditionslas i{ may deem appropriate under the circumstances. <br /> i 'Subd.12. Warranty. The City shall, where appropriate, require a <br />subdivid~ su ~bmission of a warranty/maintenance bond in the amount equal to the original <br />cost of the :_improvements which shall be in force for one year following the final acceptance <br />of any required improvements and shall guarantee satisfactory performance of said <br />improvements. <br /> <br /> ~ Subd.13. As Built Plans. Upon completion of installation of all <br />required impr6vements, the subdivider shall file with the City Administrator or designated <br />representa~ivo a tracing and two copies of plans and specifications showing all <br />impmvemO, nts as finally constructed and installed. Such as-built drawings shall be certified <br />to be tme~nd accurate by the registered engineer responsible for the installation of the <br />improvemOnts. <br /> <br />9.50.57', Sidewalks and pedestrian ways. <br /> <br /> <br />
