(d) <br /> <br />As used in Section 8.6.3 of the City Charter, the term "original assessment" shall <br />mean that the initial assessment amount which would have been assessed and <br />levied against a property for a Local Improvement Project which first extended <br />Urban Services (sewer and/or water) to said property. <br /> <br />(e) <br /> <br />As used in Section 8.6.3 of the City Charter, an assessment which is "consistent <br />with the original assessment" is that amount which would be assessed and levied <br />against a property for a Local Improvement Project which extended Urban <br />Services (sewer and/or water) to said property as if said Urban Services were <br />installed at the time the property connects to the City's sewer and/or water <br />utilities, or is levied a special assessment for said benefit. <br /> <br />4.70.04 <br /> <br />REPAIR OF SYSTEMS <br /> <br />(a) <br /> <br />Upon determination that either a private sewer system or a private water system or <br />both is a non-functional system as defined herein, the City's Building Official <br />shall certify either or both of said systems as "non-functional". <br /> <br />(b) <br /> <br />An existing home which is serviced by a non-functional private sewer and/or <br />private water system shall be required to connect to the City's sewer system if the <br />home's sewer system is non-functional or connect to the City's water system if <br />the home's water system is non-functional. The connection date shall be within <br />six months of the date on which the system was declared non-functional. <br /> <br />4.70/05 <br /> <br />SALE OF PROPERTY <br /> <br />Upon the sale or transfer of title of a residential improved property by a property owner who <br />elected to remain on a functional private sewer and/or water system, and whose property was <br />therefore not assessed for City utilities, the City may levy an assessment on said property in an <br />amount consistent with the original assessment. <br /> <br />4.70.06 <br /> <br />NOTICE TO PUBLIC <br /> <br />The City shall cause its public property records to reflect that any property not assessed because <br />the property owner elected to remain on a functional private sewer and/or private water system is <br />subject to a pending sewer and/or water system assessment or connection charge when said <br />property connects to either the City's sewer or water system. <br /> <br />4.70/07 <br /> <br />ELECTION TO REMAIN ON FUNCTIONAL PRIVATE SYSTEM <br /> <br />The procedure by which a property owner may elect to remain on a functional private sewer <br />and/or water system shall be as provided for in this Section. <br /> <br />(a) <br /> <br />Receipt of Notice. Upon receipt by the property owner of mailed notice advising <br />that a public hearing is to be held relating to the assessment of costs of Public <br /> <br /> <br />
