- 30 - <br /> <br />150.01.8 HEALTH HAZARD$ <br /> <br />150.01.8A GENI~RAL <br /> <br />Ail systems which are in a state of disrepair and/or ~mproperly constructed, or <br />which in relation to existing use constitute a hazard to safety or health or <br />public welfare by reason of either inadequate maintenance or construction, <br />dilapidation, or obsolescense, as determined by the inspection procedures in <br />Section 150.01.5 or any other effective section or city code, are for the <br />purpose of this chapter hereby declared to be health hazards. All such health <br />hazards shall be abated by repair, rehabilitation, demolition, or removal in <br />accordance with the procedure specified in Chapter 150.01.8B. <br /> <br />150.01.8B NOTICE TO OWNI~ <br /> <br /> 1. The plumbing inspector shall examine, or cause to be examined, and <br />inspect every sewage disposal system reported as improperly constructed or <br />maintained in accord with the inspection procedures as pescribed in Chaper <br />150.01.5, and if such system is found to be a health hazard as defined in this <br />section, the plumbing inspector shall give to the owner of such system written <br />notice stating the defects thereof. This notice may require the owner or person <br />in charge of the systems to within seven (7) days commence either the required <br />repairs and improvements or corrective actions to bring the system into <br />compliance with this chapter. All such work shall be completed within ninety <br />(90) days from the date of the notice, unless otherwise stipulated by the <br />plumbing inspector. If necessary, such notice may also prohibit forthwith any <br />further discharge into the system until all defects have been abated and <br />approved by the plumbing inspector. <br /> <br /> 2. Proper service of such notice shall be by personal service upon the <br />owner of record, if he shall be found within the Ramsey municipal l~m~ts. If <br />he is not found within the Ramsey municipal limits, such service may be made <br />upon said owner by registered mail or certified mail, provided that if such <br />notice is by registered mail or certified mail, t~he designated period within <br />which said owner or person in charge is required to comply with the order of <br />the plumbing inspector shall begin as of the date he receives such notice. <br /> <br /> 3. At the time of service of notice as above described, the plumbing <br />inspector shall also by mail forward a copy of said notice to the City Council. <br /> <br />150.01.8C CRITERIA FOR HEALT[IHAZARD <br /> <br />Criteria for determination that a system is a health hazard shall include, b~t <br />not be limited to, the following: <br /> <br />be <br /> <br />The appearance of on-site disposal system effluent into <br />surface waters at any time, or on the ground surface <br />continuously or intermittently over a period of fifteen (15) <br />consecutive days; <br />The exposure for more than seventy-two (72) hours of an on- <br />site system or part thereof that is in use; <br />A system in which the level of effluent is sufficiently close <br />to the ground surface to result in offensive odors. <br /> <br /> <br />
