- 30 - 150.01.8 HEALTH HAZARD$ 150.01.8A GENI~RAL Ail systems which are in a state of disrepair and/or ~mproperly constructed, or which in relation to existing use constitute a hazard to safety or health or public welfare by reason of either inadequate maintenance or construction, dilapidation, or obsolescense, as determined by the inspection procedures in Section 150.01.5 or any other effective section or city code, are for the purpose of this chapter hereby declared to be health hazards. All such health hazards shall be abated by repair, rehabilitation, demolition, or removal in accordance with the procedure specified in Chapter 150.01.8B. 150.01.8B NOTICE TO OWNI~ 1. The plumbing inspector shall examine, or cause to be examined, and inspect every sewage disposal system reported as improperly constructed or maintained in accord with the inspection procedures as pescribed in Chaper 150.01.5, and if such system is found to be a health hazard as defined in this section, the plumbing inspector shall give to the owner of such system written notice stating the defects thereof. This notice may require the owner or person in charge of the systems to within seven (7) days commence either the required repairs and improvements or corrective actions to bring the system into compliance with this chapter. All such work shall be completed within ninety (90) days from the date of the notice, unless otherwise stipulated by the plumbing inspector. If necessary, such notice may also prohibit forthwith any further discharge into the system until all defects have been abated and approved by the plumbing inspector. 2. Proper service of such notice shall be by personal service upon the owner of record, if he shall be found within the Ramsey municipal l~m~ts. If he is not found within the Ramsey municipal limits, such service may be made upon said owner by registered mail or certified mail, provided that if such notice is by registered mail or certified mail, t~he designated period within which said owner or person in charge is required to comply with the order of the plumbing inspector shall begin as of the date he receives such notice. 3. At the time of service of notice as above described, the plumbing inspector shall also by mail forward a copy of said notice to the City Council. 150.01.8C CRITERIA FOR HEALT[IHAZARD Criteria for determination that a system is a health hazard shall include, b~t not be limited to, the following: be The appearance of on-site disposal system effluent into surface waters at any time, or on the ground surface continuously or intermittently over a period of fifteen (15) consecutive days; The exposure for more than seventy-two (72) hours of an on- site system or part thereof that is in use; A system in which the level of effluent is sufficiently close to the ground surface to result in offensive odors.
