must be approved by the City Council after findings by <br />the Planning Commission and Zoning Administrator. <br /> <br />4) A permit may be approved subject to compliance with <br />conditions which are specifically set forth in the per- <br />mit and are necessary to insure compliance with the re- <br />quirements contained in this section. Such conditions <br />may, among other matters, limit the size, kind or char- <br />acter of the proposed development, require the con- <br />struction of other structures including special founda- <br />tions and soil stabilization structures, establish re- <br />quired monitoring procedures, require such alterations <br />of the site as may be necessary, require execution of <br />an agreement between the City and the developer, re- <br />quire a surety in the form of a performance bond, cash <br />escr~ or letter of credit in an amount of 150% of the <br />expected development costs as determined by the City <br />Engineer. Accompanying such agreement shall be a state- <br />ment from the owner indicating the City's right of <br />entry to the property if it becomes necessary to com- <br />plete the agreed upon work. <br /> <br />F. Fees. <br /> <br />A schedule of fees for the examination and approval of site <br />plans leading to an environmental permit and the inspection <br />of all required improvements and conditions in such plans <br />shall be determined by resolution of the City Council which <br />may from time to time change such schedule. Prior to <br />approval of any site plan, such fees shall be paid to the <br />Zoning Administrator and be deposited to the credit of the <br />general fund. <br /> <br />G. Effect of Permit. <br /> <br />5~e granting of an environmental permit under the provisions <br />of this section shall in no way affect the owners or the per- <br />mitee's responsibility to obtain the approval required by <br />any other statute, ordinance or regulation of any Federal or <br />State agency; or subdivision thereof. <br /> <br />170.0112F DNR Permits. <br /> <br />A) Excavations on shorelands where the intended purpose is <br />connection to a protected water shall require a permit from <br />the Zoning Administrator before construction is begun. Such <br />permit may be obtained only after the Commissioner of <br />Natural Resources has issued a permit to work in the beds of <br />protected waters. <br /> <br />B) Any work which will change or diminish the course, cur- <br />rent or cross-section of a protected water or wetland shall <br />be approved by the Commissioner of Natural Resources, and <br /> Ordinance #85-2 <br /> <br />Page 24 of 37 <br /> <br /> <br />
