PRINTER'S <br /> <br /> ORDINANCE NO. 87-8 <br /> CITY OF RAMSEY <br /> ANOKA COUNTY, MINNESOTA <br /> <br />AMENDMENT TO CHAPTER 110 OF THE <br />RAMSEY CITY CODE, WHICH CHAPTER IS <br />KNOWN AS THE "HEALTH SAFETY AND <br />WELFARE CHAPTER." <br /> AN ORDINANCE AMENDING CHAP.TEA <br />110 OF THE ZONING CHAPTER OF THE <br />RAMSEY CITY CODE BY THE ADDITION OF <br />SECTION 110.18 ENTITLED "REGULATIONS <br />FOR KEEPINGWILDAN MALS". <br />The City of Ramsey Ordains: <br />'SECTION t. ADDITION OF 0 RDINANCE <br /> Chapter 110, municipal code of the City of <br />Ramsey is hereby amended by add ng Ordi- <br />nance No; 87-8 to read as follows: <br />110.101 PURPOSE ANO INTENT. <br /> It is the intent of this ordinance to establish <br />regulations which will allow as a conditional <br />use the keeping of wild animals, with a Wild <br />animal license in certain zoning districts. The <br />City recognizes that wild animals require <br />special handling to assure that the health, safe- <br />ty.and welfare of the public is protected and all <br />land use conflicts are minimized. <br />i10.182 RULES & DEFINITIONS. <br /> Subdivision 1. Rules.' The language set forth <br />in the text of this ordinance shall be interpreted <br />in accordance with the.f011owing rules of cory <br />struction: <br /> A. Words used in the ~-ese~t tense, shall in- <br />clude the future; words inthe singular shall in- <br />clude the plural, and the plural the singular. <br /> B.' "Shall" is mandatory and not discre-- <br />tionary and 'may'"is permissive. <br /> Subdivision 2. Definitions. For the purposes of <br />this ordinance, the' following terms .shall have <br />t~e m~anings given them by this action. <br /> A. "At Large" means a wild animal that is <br /> ~ide of its secondary enclosure,- or when the <br /> animal is outside of its pri~ar'~ enclosure <br /> its secondary enclosure ahd not in <br /> the presence of the owner. <br /> B. "City" means the City of Ramsey. <br /> C. "Dwelling" means a building' pr portion <br /> lhereof desig'hed or Used exc us rely for resi- <br /> dential occupancy. - <br /> 'D. "Handling" means feeding, manipulating, <br /> transporting, re~straining, treating, training, <br /> working or performing an~ similar activity With <br /> respeCt'to a w[Id~a~imal: <br /> E. ' mpound"..r~ean~ to seize and hold in <br /> legal custody. <br /> F "The Keeping' of Wild Animals" means <br />possessing and handling of Wild .animals on any <br />property and providing such an animal with the <br />necessities of life such as feeding and shelter- <br />ing. The keeping of wild animals may include <br />animals being used or intended to be used for <br />.research, training, breedihg, boarding, as a. <br />personal pet, or for agricultural purposes. The <br />keeping of a wild animal may also include wild <br />animals intended to be used for exhibition pro. <br />riding, that such animals are not exhibited <br />within the City, Such as in the case of a public <br />showing, circus or zoo. " <br />· G../~Livestock" means a typic.al farm animal <br />kept for agricultural use, pleasure or profit in- <br />ciurdir~g but'not limited to horses, mules, sheep,' <br />goats,.cailtle, swine, fowl, rabbits and mink. <br />H. "Lot" means a tract, plat or portion of a <br />subdivision or other parcel or land intended as <br />· a unit for the purpose, whether immediate or <br />'future, or transfer of ownership or for the build- <br /> ~n§ ~elop~rlen:t. ~ ·' ' ' <br /> : .,1:~ "Owner" means a person who keeps a wil~' <br /> ~l'JmaJ or th~ parents or guardians of such a;' <br /> per, son unclear 18 years of age. <br /> ~:~l. "Person" means an individual, partner- <br /> 'rd'p, firmi joint stock company, c~rpo~a~'ion, <br /> afion, uninco[po!'ated association of indi~ <br /> , estate, or other legal entity. <br /> · "Primary Enclosure""means the secure <br /> ~'tr, bcture where the wild animal is enclosed in <br /> th~ eveniogs, during inclement weather· and at <br /> such~oth~t%.tiq~es-when the Wild animal·is ndt <br /> pe~-ni'i~t~f to be in the secondary renclbsure: <br /> L. "P. or~table Prirttary Enclosure"-means the <br /> portable s~tfb~tm'~'iu~d to ~onfi~e a wild animal <br /> <br />AFFIDAVIT OF PUBLICATION <br /> <br />yard and 50 feet rear lard. <br /> (d) The structures, primary and secondary <br />enclosures and ail areas in which a wild animal <br />is handled shall be located a minimum of 300 <br />feet from all dwellings other than that of the <br />owner. <br /> (e) The activity areas in which a wild animal <br />is handled shall be screened or landscaped in <br />such a manner as to prevent them from being <br />visible at any time of the year from the road <br />right-of-way, and public properties· <br />110.184 LICENSE <br /> Subdivision 1. Prohibition. No person shall <br />keep a wild animal ~ nless a wild animal license <br />~as been approved by the City for that person <br />and that activity, in accordance with this ordi- <br />nance. <br /> Subdivision 2. Submittal of Application. Com- <br />plete application for a wile animal license shall <br />include the following: <br /> A. Ten copies of the completed application <br />form. <br /> B. Ten copies of a letter explaining in detail <br />the proposed use and addressing regulations in <br />110.183, Subdivision 2, and review criteria in <br />i10.184, Subd.5. <br /> C. Ten copies of an accurate site plan (drawn <br />to scale) or survey of the lot on which the pro- <br />posed use would occur and the adiacent lots <br />showing: (1) lot dimensions (2) location, size <br />and configuraton of the area proposed to be us- <br />ed for the keeping of wild animals - including all <br />existing and proposed buildings, structures, and <br />enclosures, (3) setbacks from front lot Line, side <br />lot lines, and rear lot line, and distances from <br />neighboring dwellings, pastures, barns, and <br />corrals, (4) vegetation and terrain features <br />such as steep slopes, wetlands, woods and any <br />natural and proposed screening or landscaping, <br />(5) driveways, public and private roadways, <br />parking and loading areas, (6) easements for <br />roads, access, open space, views, and utilities, <br />and (7) location of well and septic. The City <br />reserve~'the right to require a certificate Of <br />survey. <br /> D. Two copies of all permits required from <br />the Minnesota Department of Natural Resources, <br />United States Department of Agriculture, Unit- <br />ed States Fish & Wildlife, and any other gov- <br />ernmental agency. <br /> E Two copies of the owner's qualifications,. <br /> list of professional references and any other <br /> bac:kground materials are required by the Zon- <br /> ing Administrator. <br /> F Payment 'of application fee and <br /> miscellaneous fees as established by the City <br /> resolutions ena ordinance. <br /> G. Two copies of building plans for primary <br /> and secondary enclosures. <br /> H. Any additional information .found neces- <br /> sary by the City Zoning Administrator. <br /> <br /> Subdivision 3. Application Deadline. A com- <br /> pleted application for a wild animal license <br /> shall be submitted no later than 19 days before <br />· the next regularly scheduled Planning Commis- <br /> sion meeting. <br /> Subdivision 4. Review of City CounCil and <br /> Planning Commission. Upon submittal of a <br /> completed application, the Zoning Ad- <br /> ministrator shall schedule a public hearing at <br /> the next Planning Commission meeting. The <br /> Police Chief shall receive a copy of the applica- <br /> tion and forward any recommendations to the <br /> Zoning Administrator who shall then review the <br /> application and police comments and may <br /> make recommendations to the Planning Com- <br /> mission. The Planning Commission shall con- <br /> sider the application for wild animal license <br /> and thereafter make recommendations to the <br /> City Council. The City Council shall then ap- <br /> prove, approve with modifications, or deny the <br /> application for a wild animal license by resolu- <br /> tion Which shall set forth in detail any condi- <br /> tions and restrictions to which the approval i.s <br /> subject or reasons for denial. <br /> If a renewal of a wild animal license is being <br /> applied for with no changes from the wild <br /> animal license issued by lhe City for the <br /> previous year, the Zoning Administrator may <br /> place the application for the renewal of a wild <br /> animal license on the agenda of the ne~t City <br /> <br />during the processing and reviewing of the ap- <br />plication, which exceed the application fee. <br />Such expenses shall include, but are not limited <br />to, consultants and other professionals and the <br />cost of printing~ mailing, and supplies. Such <br />fees shall become due and payable Immediately <br />upon notification by the City. The City shall <br />provide upon the request of the applicant, a <br />breakdown of the various expenses incurred by <br />the City. The City may withhold any final action <br />on an application for a wild animal license or maging editor of the <br />variance and/or rescind prior actions until all Df the facts which are <br />fees are fully paid. The Cily may require addi. <br />tional deposits, above and beyond the appllca- <br />lion fee, if found necessary. <br />110.187 INSPECTION AND REVOCATION ;tituting qualification <br />OF LICENSES OR VARIANCES <br />The City may at any time Inspect the lot and ~, 33]^.07, and other <br /> structures where a wild animal is kept to <br /> determine if the license and/or variance, and <br /> the conditions and restrictions of that license or <br /> variance are being strictly adhered to. Owners in violation of this ordinance <br /> will have .ten days to correct the violation and <br /> redeem a wild animal. The owner Is responsible <br /> for all costs incurred by trie city to capture, <br /> keep, and/or destroy a wild animal. If a wild <br /> animal is not redeemed, the City will dispose of <br /> such wild animal in any manner it deems nec- <br /> essary such as (but not limited to) selling, <br /> destroying, or donating to an appropriate <br /> organizatio~ or agency .................... <br /> Subdivision 2. Rabies. A wild animal capable <br /> of transmitting rabies which has been known tq <br /> have bitten a person shall be quarantined and <br /> observed for rabies, under the direction of a <br /> licensed veterinarian for a period of time and In <br /> facilities deiermined to be adequate by that <br /> veterinarian and the City. If a wild animal is <br /> proven to be rabid, the wild animal shall be <br /> destroyed. If a wild animal is proven to not be <br /> rabid by a licensed veterinarian, It will be <br /> returned to the owner. <br /> Subdivision 3. Enforcement Authority. <br /> Enforcement officers shall have the right to ~,~lr~. [xpm!sMayl0, 1989,~ <br /> d~stroy a wild animal posing an immediate <br /> threat of serious harm to any person, livestock or <br /> house pet. <br /> 110.1810 PENALTY <br /> A person WhO fails to comply with or violates <br /> provisions of the ordinance or the restrictions of <br /> a conditional use permit, wild animal license or <br /> variance shall be subject to a fine of not more ' <br /> <br /> than $700 for each day when the violation per- <br /> sils and/or imprisonment for a period not to ex- <br /> ceed 90 days, or maximum penalty allowed by <br /> law, such fine and imprisonment being put. <br /> suant to the ~provisions of Minnesota Statute <br /> Chapter 335.
