<br /> O. "Structure" means anything construcled
<br /> or erected, the Use of which requires a perma-
<br /> nent location on the ground or attachment to
<br /> something having a permanent location on the
<br /> ground, such as a fence, wall, or building.
<br /> P. "Wild Animal" means a mammal, large or
<br /> poisonous reptile and bird which, in their un.
<br /> captured wild state, have the physical capacity
<br />
<br />· i't° be dangerous to the s~fety and welfare of any
<br /> person or property. Examples of such wild
<br /> animals are (but not limited to these examples)
<br /> bears, lions, ~wolves, coyotes, cougars, bison,
<br /> tigers, par~thers, monkeys, apes, large
<br /> alligators and crocodiles (greater than four feet
<br /> in length), large snakes, (greater than six feet),
<br /> and poisonous snakes, excluding dogs, cats,
<br /> other traditional house pets ahd liveslock.
<br /> Reducing such mammal,~, reptiles and birds
<br />to captivity, whether trained, ·raised or bred in
<br />captivity or otherwise considered domesticated
<br />in any manner; shall not remove such wild
<br />'animals from these requirements and regula-
<br />tions. .
<br />~1.10. i83 GENERAL REGULA!ION$
<br /> Subdivision 1. Prohibition. No. p~rson, shall
<br /> keep. a wild animal unless sOch a use is
<br /> specifically permitted by this ordinance and all
<br /> regulaiions are complied with.
<br /> : Subdivision 2. Regulations~
<br />-: A: Enclosures· .
<br /> (I) A wild animal shall be conf!.ned, sheltered
<br /> and led in a primary enclosure contained eh.
<br /> tirely with asecondary enclosure:- - · ' ·
<br /> (2) ~AII primary and secondary enclosures
<br /> shall meet minimum requirements of structural
<br /> soundness and security as deemed satisfactory
<br /> by the City. All primary and secondary
<br /> enclosures -
<br /> ia) ~hall be constructed of steei bar, link,
<br /> wire or other suitable material of sufficient
<br /> strength to contain the proposed animal;
<br /> (bi shall be adquately braced and securely
<br /> anchored at ground level;
<br />
<br /> (c) shall be constructed such as to prevent a
<br /> wild animal from digging out from under the
<br /> enclosure; '
<br /> id) shall be key or combination locked to pre-
<br /> vent unauthorized entrance; ..
<br /> (e) shall be located so.that all access tO
<br /> primary enclosures must be 'from within the
<br /> secondary epclosure;
<br /> (fi shall be adequately Signed Io notify the

<br /> B, Transportation: Th~ h'ansportation of a
<br /> wild .animal.outside of the secondary enclosure

<br /> · C.;RUnning.at Large·
<br /> (1) It shall be prohibited for a wild animal to

<br /> (3} Tools for capturing ~/ild anirfnals shall be
<br />'readily accessible, such as traps, firearms,
<br /> tran. quilizing guns and nets. D. Sanitation and Health.
<br /> (1) The lot on which a Wild animal iS kept
<br />shall be mairitained in-a clean, sanitary and
<br />neat manner in accordance with the conditions
<br />of the permit. '
<br /> (2) A wild animal shall be maintained in a
<br />healthy 'slate so as to prevent 1he transm'ittal of
<br />disease to olher.animals or persons·
<br /> (3) All animal waste shall be properly and-
<br />timely disposed of ih accordance with the con-
<br />dill. ions Of lhepermit.
<br /> E. Zoning and Lot Requirements.
<br /> (1) All zoning'ordinance regulations shall be
<br />complied with.
<br /> (2) Additi0Pal r~gulations shall be as follows:.
<br /> (~) The keeping of' wild animals shall be
<br />alioWe~l'only as a condit'ional use in any zoning
<br />
<br /> F. Aesthetics, including the appearance of ~he
<br /> lot and stru.cture where a wild animal is kept.
<br /> G. Compliance with the City Zoning Ordl-.
<br /> hence and other City ordinances.
<br /> H. Regulations of the Minnesota Department
<br /> of Natural Resources, United States Depart-
<br /> ment of Agriculture, United States Fish &
<br /> Wildlife, or any other governmental agency.
<br /> I. Nature and characteristics of each type of
<br /> animal being proposed such as its size,
<br /> strength, disposition, and Its ability to harm a
<br /> person or property.
<br /> J, Other criteria found relevant by the City..
<br /> The application shall prove that the use as
<br /> proposed in the wild animal license application
<br /> would not result in any detrimental effects as
<br /> per the criteria Ii§ted above.
<br /> Subdivision 6. Conditions of Apprpval. In ap-
<br /> proving .an application for a wild anlmal
<br /> license, the City may attach conditions and
<br /> restrictions as it finds necessary, Including but
<br /> not limited to the following:
<br /> A. Restrictions on the number and type of
<br /> animals·
<br /> R. Setbacks greater than those required in
<br /> 110.183, Subd. 2.
<br /> C. Minimum and/or maximum distance be-
<br /> tween primary and secondary enclosures.
<br /> D. Minimum height of enclosures·
<br /> E. Size of the enclosure,
<br /> Subdivision 7. Expiration. The wild animal
<br /> license shall expire twelve months from the
<br /> date of issuance.
<br /> Subdivision 8. Renewal of License. Applica-
<br /> · lion for renewal of a wild animal license with.
<br /> any changes Shall be made a minimum of 19
<br /> days before the next regularly scheduled Plann-
<br /> ing Commission meeting. Application for
<br /> renewal with no changes shall be made 14 days
<br /> before the next regularly scheduled City Coun-
<br /> cil meeting providing that the public hearing
<br /> 'and review before the Planning Commission
<br /> has. been Waived. The City may require an in-
<br /> spection upon renewal of a wild animal license
<br /> and shall reserve the right to have said inspec-
<br /> lion performed by an approved qualified consul-
<br /> tant.

<br /> Subdivision t. Va'riance and Review Criteria.'
<br />' ' Where the City finds that extraordinary hard.
<br /> ships or pracllcal difficulties may result from
<br /> strict compliance wilh the provisions of this or-
<br /> dinance, and the purposes of this ordinance
<br /> may be served to the same or greater'extent by
<br /> an alternatlve~proposal, the City may approve
<br /> variances to this ordinance so that substantial
<br /> iustice may be done and fha public interest
<br /> secured, provided that: (ii such a variance
<br /> shall r~ot have the effect of nullifying fha Intenl
<br /> and purpose of this ordinance and (2) the City ·
<br /> shall not approve variances unless, based upon
<br /> the evidence presented to It, it finds that:
<br /> A. The granting of the variance would not be
<br />' detrimental to fha public safety, health, or
<br /> · welfare or lnlurlous to property.
<br /> B. The conditions which a variance would be
<br /> based upon are unique to that application for
<br /> which the variance is sought and are hal ap-
<br /> plicable generally to other applications·
<br /> C. The strict enforcement of this ordinance
<br /> would' result in unreasonable and unnecessary
<br /> requirements or restrictions because a par-
<br /> ticular hardship would result, as distinguished
<br /> from an inconvenience.
<br /> D. The variance would not in any manner
<br /> vary the provisions of the Ramsay Comprehen-
<br /> sive Plan.
<br /> Subdivision 2. Application and Review. The'
<br /> .application procedure for a variance from this
<br /> ordinance shall be the same as for a wild
<br /> animal license, 110.184, Subdivision 2 through 4.
<br /> Variances may be reviewed concurrently ·
<br /> . wilh an application for a wild animal license.
<br /> . Subdivision 3. Condllions of Approval. In ap-
