<br /> The City. Council of the City of Ramsay hereby
<br /> ordains:
<br /> 170.071 POI~ICY AND AUTHORIZATION
<br /> The purpose of this ordinance is to control
<br /> bluffland and riverland development to protect
<br /> a~d'pre~erve the scenic,' recreational, natural,
<br /> histori[cal and scenic values of the Rum River in
<br /> RamSay In accordance with Minnesota Statutes,
<br /> S~e~:tlon 10~.31 - 104.40, Minnesota Regulations
<br /> RIR 78-81, end the Management Plan for the-Rum
<br /> I~lvei' (6 A~tCA R 1.2700 - 1.2720).

<br /> ~ '~0,073 SCOPE AND INTERPRETATION
<br /> ~-The provisions of this ordinance shall apply to
<br /> t~e designated Scenic River Land Use District in
<br /> accordance with the property descriptions in 6
<br /> MCAR 1.2700 - 1.2720. Where 'this ordinance
<br /> Imposes greater restrlctions~ the provisions of
<br /> 'this ordinance shall prevail. Any land use within
<br /> the Scenic River Land Use District shall be in
<br /> compliance with the term§ of this ordinance.
<br /> P~rmits are required by lhis ordinance for the
<br /> Construclion of bbildings, water supplies and
<br /> sewage treatment systetns, grading and filing of
<br /> natgral' topography and erection of signs within
<br /> the ~ce~ilc River L~and Use District.
<br /> '~: ~'~0.073.5 DEFINITIONS
<br /> ~.~0.07~ DISTRICT APPLICATIONS
<br />~The S~enlc River Land Use District shall be
<br />~l~vlded into lwo districts; that portion within the
<br /> · C~ity's 1990 Urban Area and the remaining
<br /> portion within the Cily's Rural Area. The Scenic
<br /> RiVer Land Use District sha be shown on the
<br /> O{flclal Zoning Map. Where the provisions of this
<br /> d~diriance are in conflict with the Management
<br /> Plan for the Rum River, the provisions of the
<br /> · R~JmRIverManagementPansha apply.
<br /> 170.075 USES '
<br /> 170.075.1 URBAN ARIMA
<br /> · Permitted uses are all permitted uses allowed
<br /> and regulated by the applicable zoning district
<br /> underlying the Scenic River Land Use District in
<br /> the..Urban Area as indicated on the Official
<br /> Zoning Map. Pu~ic roads, utility' crossings and
<br /> otl private and commercial recreation uses shall
<br /> be conditional uses. Conditional ,uses are all
<br /> cond'lfional.uses and applicable attached
<br /> condit~o?.s-allowed and regulated by the
<br /> ap_p.!i.cable zoning district underlying the Scenic
<br /> Rlve~'Land Use District as indicated on the
<br /> Official zoning Map. ·

<br />Any ~l;.~j~ing and filling work done within the'A
<br />Scenic River Land Use District shall require a SS
<br />perm it affd shall comply with the following:
<br />1. Grading and filling not part of'a permitted
<br />or conditional use is not permitted;
<br />2. Gradj~ng and filling as part of a permitted or
<br />' conditional use requires a permit from the City;
<br />3. Grading and filling shall be completed so as
<br />to minimize effects to the nalural topography.
<br />170.07.11 ADMINISTRATION
<br />The provisions of thi§_ordinance shall be
<br />administered by the City of Ramsay. The Board
<br />of Adjustment shall act upon all questions and
<br />appeals of this ordinance· Permit and inspection
<br />fees may be establishe¢ by resolution by the City
<br />of Ramsay.
<br />1~0.0711.21 SUBSTANDARD LOTS
<br />1. Lots of record which do not meet the
<br />dimensional requirements of this ordinance shall
<br />beallowed as building sites provided such use is
<br />a permitted use; and
<br />2. In a group of two or more contiguous lots
<br />under single ownership when any individual lot
<br />does not meet the requirem~.nts of the
<br />ordinance, such lot cannot be a separate parcel
<br />for s~le or development purposes, but mum be
<br />combined with adjacent lots under the same
<br />ownership so that the combination :of lots will
<br />equal one or .more lots each meeting the
<br />requirements of the local ordinance.
<br />170.0711.22 NONCONFORMING USES .
<br />1. Nonconforming uses (those u~es whlch are
<br />prohibited by this ordinance .but which are in
<br />existence prior to this ordinance) shall not be
<br />intensified, enlarged, or expanded.
<br />2. NonconfOrming sanitary systems (those
<br />systems whi~:h are inconsTstent with the
<br />performance standards .of the City and
<br />N~innesota Pollution Conlrol Agency) shall be
<br />brought into conformity or discontinued within
<br />five (5) years of enactment of this ordinance.
<br />170.0711.23 SU BSTAN DAR D USES
<br />All Use~ in existence prior tothe enactment of
<br />this ordinance which meel the allowable use
<br />criteria for this ordinance but do not meet.the
<br />minimum dimensional requirements shall be
<br />substandard uses.
<br />I. Any structurai alteration or addition to a
<br />substandard use shall not be allowed.
<br />2 Substandard signs shall be gradually
<br />eliminated over a period of time.
<br />170.0711.3 VARIANCES
<br />Variances require the presenc'e of the
<br />following conditions:
<br />- 1. Strict enforcement of I~nd use controls will
<br /> result in unnecessary hardship, .
<br /> 2. A variance would not be contrary to the
<br /> intent and purpose of the zoning provisions of
<br /> this ordinance·
<br /> 3. Tliere are exceptional circumstances unique
<br /> to the subject property~ ,"
<br /> ~. A variance will not'allOW any use which [s
<br /> neither a permitted or conditional use.
<br /> 5. A variance will not alter the essential
<br /> character of the locality as established by. the
<br /> Management Plan for the Rum River. 170.0771.4 PLATS
<br /> Copies of all plats shallibe forwarded to the
<br /> Commissioner; o~ the .DNR. Approval of
<br /> inconsistent plats must be certified by the
<br /> Commissioner of the DNR.
<br /> 170.0711.5 AMEN DMENTS'
<br /> Amendments to this ordinance must be
<br /> certified by the Commissioner of )he DNR.
<br /> Requests for afftendments shall be initiated by a
<br /> petition of the owner of the actual property or by
<br /> action ~f the Ramsey City Council,
<br />170.0711.6 CON DI TIONAL USE'PERMIT
<br />Conditional use permit applications must be
<br />submitted to the. Commissioner of the DNR'at
<br />.least 30 days prior to any _consideration by the
<br />City or such appflcation. Conditional Use permits
<br />relating to private or commercial recreational
<br />development must be certified by the
<br />Commissioner of the DNR.
<br /> 170.0711.7 CERTIFICATION
<br /> Certain land use decisions within'the District
<br />must be certified by the Commission of fl3e DN R.
<br />These ~decisions include rezoning, variances
<br />from provisions o[this ordinance, pla~t ~pprova'l
<br />of inconsistent plat§~ and condi{ional use perm ts
<br /> for pravate ~,.a~l~l.~:~c:~lf(e~:~.~ .f ,~.h recreational
<br /> development.
