RAMSE¥, MINNESOTA. · -An Ordinance piecing a moratorium on sub- i ' divisions of land within the City of Ramsey. The City Council of'the City of Ramsay does or- dain: ' · SeCt!~nl. PU~OSE The City Council finds: I 1) r~'~lat the sUbdivision of land wi.thin the City of iRa~nSey lsa significant process which has long term effects On the overall and ultimate develol~ment of '. the City; ~ 2) That In order to properly guide this develop- ~ meat planned subdivisions are necessary In order to iprotect the health, safety and welfare'of the com- munity; 3) That the 1980 Minnesota Legislative sub- stanflally amended the City's subdivision enabling ~ authority by passage of Chapter 566 of the 1980 Legislative Session, which Chapter amends M.S.A. 462.351 et al; 4) That In order to Implement the provisions of M.S.A. 462.351 et al as amended by the 198~ · ~ legislature, the City needs time to review Its existing subdivision regulati6ns and revise Its existing ~ subdivision regulations In' accordance with the ; Minnesota Legislative 1980 Actions; i' $) That In erd~r to protect the planning process and the health, safety and welfare of Its citizens, the City needs to place a moratorium on land sub- divisions while Its subdivision regulations are ,amended and It Is for this purpose that this brdlnance Is promulga~ted, Section 2. AUTHOR ITy This ordinance Is ,adopted pursuant ,to that Ohorlty granted the'City by,M.S.A. 462.351 Subd. 4. action 3. MORATORIUM'AND TERM · A moratorium on the Subdivision of any parcel of · land In the City of Ramsay Is hereby established for a · period of'slx (6) months from the effective date of this ordinance. "Subdivision" as used herein shall mean the ! division of-a parcel of land Into two (2) or more tseparate parcels where the result Is the creation of one er more parcels which is twenty (20) acres or iless In size and having a width less than 500 feet. Sedion 4. VAR:lAN'CE .~ The City Council In Its discretion may grant a variance to the subdivision moratorium created herein If the proposed subdivision has been approved by the City Council and Planning Commission as being substantially in compliance (La the City's opinion) with the new subdivision regulations to be adopted by the City. The City Council may require' that the subdivider enter Into a written agreement wltti the City wherein his subdivision proposal is described and he agrees In writing to follow the City's new subdivision regulations to be adopted. Section 5. INSTRUCTION The City Staff Is hereby directed forlhwlth to present proposed subdlvlsloff regulations based on the enabling authority of M.S.A. 462.351 et al to the City's Planning Commls~lofl for Its review and ~ereafter to the City Council for Its final review and adoption. Section 6. LIMITATIONS This ordinance shall not halt, delay or Impede a subdivision which has been g~ven preliminary ap- proval prior to Its effective date. Section 7. (6) Said newspaper files a copy of each issue immediately with the State Historical Society. (6a) Said newspaper is made available at single or subscription prices to any person, corporation, partnership, or other unincorporated association requesting the newspaper and making the applicable payment. (7) Said newspaper has complied with all the foregoing conditions for at least one year preceding the day or dates of publication mentioned below. (8) Said newspaper has published and filed with the Secre- tary of State of Minnesota a sworn United States Post Office second class statement of ownership and circulation as of October of each year beginning in 1980.
