RAMSE¥, MINNESOTA. <br /> · -An Ordinance piecing a moratorium on sub- <br /> i ' divisions of land within the City of Ramsey. <br /> <br /> The City Council of'the City of Ramsay does or- <br /> dain: ' <br /> · SeCt!~nl. PU~OSE <br /> The City Council finds: <br /> I 1) r~'~lat the sUbdivision of land wi.thin the City of <br /> iRa~nSey lsa significant process which has long term <br /> effects On the overall and ultimate develol~ment of <br /> '. the City; <br /> ~ 2) That In order to properly guide this develop- <br /> ~ meat planned subdivisions are necessary In order to <br /> iprotect the health, safety and welfare'of the com- <br /> munity; <br /> 3) That the 1980 Minnesota Legislative sub- <br /> stanflally amended the City's subdivision enabling <br /> ~ authority by passage of Chapter 566 of the 1980 <br /> Legislative Session, which Chapter amends M.S.A. <br /> 462.351 et al; <br /> 4) That In order to Implement the provisions of <br /> M.S.A. 462.351 et al as amended by the 198~ <br /> · ~ legislature, the City needs time to review Its existing <br /> subdivision regulati6ns and revise Its existing <br /> ~ subdivision regulations In' accordance with the <br /> ; Minnesota Legislative 1980 Actions; <br /> i' $) That In erd~r to protect the planning process <br /> and the health, safety and welfare of Its citizens, the <br /> City needs to place a moratorium on land sub- <br /> divisions while Its subdivision regulations are <br /> ,amended and It Is for this purpose that this brdlnance <br /> Is promulga~ted, <br /> Section 2. AUTHOR ITy <br /> This ordinance Is ,adopted pursuant ,to that <br />Ohorlty granted the'City by,M.S.A. 462.351 Subd. 4. <br />action 3. MORATORIUM'AND TERM <br /> · A moratorium on the Subdivision of any parcel of <br /> · land In the City of Ramsay Is hereby established for a <br /> · period of'slx (6) months from the effective date of <br /> this ordinance. <br /> "Subdivision" as used herein shall mean the <br /> ! division of-a parcel of land Into two (2) or more <br /> tseparate parcels where the result Is the creation of <br /> one er more parcels which is twenty (20) acres or <br /> iless In size and having a width less than 500 feet. <br /> Sedion 4. VAR:lAN'CE <br /> .~ The City Council In Its discretion may grant a <br /> variance to the subdivision moratorium created <br /> herein If the proposed subdivision has been approved <br /> by the City Council and Planning Commission as <br /> being substantially in compliance (La the City's <br /> opinion) with the new subdivision regulations to be <br /> adopted by the City. The City Council may require' <br /> that the subdivider enter Into a written agreement <br /> wltti the City wherein his subdivision proposal is <br /> described and he agrees In writing to follow the <br /> City's new subdivision regulations to be adopted. <br /> Section 5. INSTRUCTION <br /> The City Staff Is hereby directed forlhwlth to <br /> present proposed subdlvlsloff regulations based on <br /> the enabling authority of M.S.A. 462.351 et al to the <br /> City's Planning Commls~lofl for Its review and <br /> ~ereafter to the City Council for Its final review and <br /> adoption. <br /> Section 6. LIMITATIONS <br /> This ordinance shall not halt, delay or Impede a <br /> subdivision which has been g~ven preliminary ap- <br /> proval prior to Its effective date. <br /> Section 7. (3) Said newspaper, in at least half of its issues <br />each year, has no more than 75 per cent of its printed space comprised of advertising <br />material and paid legal notices; and in all of its issues each year, has 50 per cent of its news <br />columns devoted to news of local interest to the community it purports to serve, and not <br />more than 25 per cent of its total non-advertising column inches in any issue duplicates any <br />other publication. (4) Said newspaper is circulated in and near the municipality which it <br />purports to serve, has at least 500 copies regularly delivered to paying subscribers and has <br />entry as second-class matter in its local post-office. (5) Said newspaper purports to serve <br />the City of Anoka in the County of Anoka and has its known office of issue in the City of Coon <br />Rapids in said county. (6) Said newspaper files a copy of each issue immediately with the <br />State Historical Society. (6a) Said newspaper is made available at single or subscription <br />prices to any person, corporation, partnership, or other unincorporated association <br />requesting the newspaper and making the applicable payment. (7) Said newspaper has <br />complied with all the foregoing conditions for at least one year preceding the day or dates of <br />publication mentioned below.
