5. As an alternate to 3 above, the City may resurface ("over-lay") <br />or seal coat the street in accordance with the recon~nendation of <br />the City Engineer any of these improvements shall be assessed 100% <br />to benefitting landowners. <br /> <br />6. All upgrading of non surfaced streets to Class V standards shall <br />be assessed 100% to the benefitted property owners. <br /> <br />7. Only routine maintenance and emergency maintenance on City streets <br />shall be paid for from the City's general fund. <br /> <br />C. Section 210.015 DEFINITIONS is hereby amended to read as follows: <br /> <br />4. The "unit area" for assessment purposes shall be the average unit <br />area of the subdivided parcels lying within the area of benefit. <br />Large units which maybe divided into two (2) or more average units <br />shall be assessed accordingly. Park areas shall be excluded fr~-a <br />assessments. For corner lots the unit area assessment shall be adjusted <br />such that any corner lot abutting any assessable street improvemsnt <br />shall be assessed only once. In the event that only one street adjacent <br />to a corner lot is improved, the corner lot shall be assessed at the <br />tim~ that the street which anydriveway enters into is improved. <br />However, in the event all driveways from a corner lot enter into a <br />major thoroughfare or collector street which is improved byother than <br />local funds, that lot shall be assessed for a one-half unit at the time <br />the side street is improved. <br /> <br />6. "Routine Maintenance" shall consist of maintaining streets in their <br />original condition at the time of their acceptance by the City. Seal <br />coating and "overlays" shall notbe construed as routine maintenance. <br /> <br />SECTION 2. EFFEC~ DATE <br /> <br /> This ordinance becomes effective upon its passage and publication according to <br />law. <br /> <br />PASSED by the City Council this the 30th day of September, 1980. <br /> <br /> <br />
