R,A~SEY <br /> · :', , . , ANOKA <br /> STATE OF MINNESOTA · <br /> AMENDMENT TOrCHAPTER 210.01 wHfcH' IS <br /> KNOWN AS THE "STREET ASSESSMENT" <br /> CHAPTER OF THE CITY CODE <br /> AN ORDINANCE AMENDING CHAPTER 210.01 <br />OF THE CITY CODE OF RAMSEY, MINNESOTA <br /> The City Council of the City of Ramsey ordains: <br /> SECTION 1. AMENDMENT <br /> A. Section 210.01' FINANCING ARTERIAL <br />STREETS WITHOUT LOTS FRONTING <br />i-Paragraph 2 shall bo amended to read as follows: <br /> 2. 'Upgrading of arterial streets, not lying in the <br />city's' thoroughfare system and only benefiting a <br />localized area shall be financed by aid programs and <br />assessment of the benefiting' properly. Assessments <br />shall be made on d unit area basis with assessments <br />on undeveloped property lying within the area being <br />"deferred" until time of development for a <br />maxlmum'perlqd of five (5) years. Assessments <br />shall be made to the extent fo cover costs' no/ <br />available from other sources. <br /> B. Section 2i0.014 FINANCING LOCAL <br />RESIDENTIAl. AND INDUSTRIAL STREETS shall <br />be amended t0 read as follows: <br /> 210~014'FINANCING LOCAL RESIDENTIAL AND <br /> ~USTR IAL STREETS <br /> dacem~nt of' all residential and Industrial <br /> ets shall be financed by assessing the benefitting <br />property owners on a front foot or unit basis. <br /> 2. The improvemenl of any collector street or <br />malor thoroughfare Flay be fully or partially <br />a.sq~ssed I~ ~ the benefitting property owners <br />dePending on the particular circumstances of e~ch <br />cas~ as deterl~lned by the City Council. <br /> 3. For.the. purpose of establishing a replacemenl <br />police for streets, it !~. hereby delermlned that the <br />esllmat~l useb'te II~e of a street shall be fifteen (15) <br />ye'ars from the date of Initial cbnsl~uc~lon to the date <br />'o~ the proposed r~co.~structlon:. <br /> 4. When the condition of a street surface has <br />deteriorated to the point where excessive main- <br />tenance cost Is Incurred by the City, or a malorlty of <br />abutting residents request an Improvement, the City <br />'Council may order a public hearing on proposed <br />improvements for that street. If the City Council, <br />following the hearing, decides that Improveme, nts <br />are necessary, it may elect to completely recon- <br />struct the street and assess 100% of the cost of such <br />i~provemenl against benefitting property owners In <br />the matter hereinbefore described. <br /> 5. As an alternate to 3 above, the CIly may <br />resurface ("over-lay") or seal coat the slreef In <br />acco?dance with the recommendation of Ihe City <br />Engineer any of these Improvements shall be <br />assessed 100% to benefilting landowners. <br /> 6, All upgrading of non surfaced streets to Class V <br />standards shall be assessed 100% to the benefitted <br />property owners. , <br /> 7, Only routine maintenance and emergency <br />maintenance on City strei~ts shall be paid for from <br />the City's general fund. <br /> ~, Section 210.015 DEFINITIONS is hereby <br />amended to read as follows: <br /> 4. The "unit area" for assessment purposes shall <br />be the average unit area of the subdivided parcels <br />lying wllhln the area of benefll. Large units which <br />may be divided Into two (2) or more average units <br />shall be assessed accordingly. Park areas shall be <br />exclude/d from assessments. For corner lots the unit <br />area assessment shall be 'adlusted such 1hat any <br />corner lot abutting any assessable street im- <br />provement shall be assessed only once. In the event <br />lhat only one street adiacent to a corner lot Is Ira- <br />proved, the corner lot shall be assessed at the time <br />that.the street w~hlch any driveway enters into Is <br />Improved. However, in the event ali drlveway~ from <br />a corner lot enter Into a malot thoroughfare or <br />collector street which Is Improved by other lhan local <br />funds, that lot shall be assessed for a one-half unit at <br />the time the side street is improved. <br />· 6. "Routine Maintenance' shall consist of <br />malntainlng streets In their original condition at the <br />time of their acceptance by the City. Seal coating and <br />· "overlays" shall not be construed as routine <br /> maintenance. <br /> SECTION 2. Bodley, being duly sworn, on oath says he is and during all the times herein stated <br />has been the managing editor of the newspaper known as Anoka County Union and has full <br />knowledge of the facts herein stated as follows: (1) Said newspaper is printed in the English <br />language in newspaper format and in column and sheet form equivalent in printed space to <br />at least 900 square inches. (2) Said newspaper is a weekly and is distributed at least once <br />each week. (3) Said newspaper has 50 per cent of its news columns devoted to news of local <br />interest to the community which it purports to serve and does not Wholly duplicate any other <br />publication and is not made up entirely of patents, plate matter and advertisements. (4) <br />Said newspaper is circulated in and near the municipality which it purports to serve, has at <br />least 500 copies regularly delivered to paying subscribers, has an average of at least 75 per <br />cent of its total circulation currently paid or no more than three months in arrears and has <br />entry as second-class matter in its local post-office. (5) Said newspaper purports to serve <br />the City of Anoka in the County of Anoka and it has its known office of issue in the City of <br />Coon Rapids in said County, established and open during its regular business hours for the <br />gathering of news, sale of advertisements and sale of subscriptions and maintained by <br />Thomas B. Pease or persons in its employ and subject to his direction and control during all <br />such regular business hours and at which said newspaper is printed. (6) Said newspaper <br />files a copy of each issue immediately with the State Historical Society. (7) Said newspaper <br />is made available at single or subscription prices to any person, corporation, partnership or <br />other unincorporated association requesting the newspaper and making the applicable <br />payment. (8) Said newspaper has complied with all the foregoing conditions for at least one <br />year preceding the day or dates of publication mentioned below. (9) Said newspaper has <br />filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 <br />thereafter an affidavit in the form prescribed by the Secretary of State and signed by Arch <br />G. Pease or Thomas B.
