130.O95 - Execution of Application. If the application is by a natural person, it <br />shall be s~gned and sworn to by such person; if by a corporation, by an officer there- <br />of; if by a partnership, by one of the partners; if by an unincorporated association, <br />by the manager or managing officer thereof. If the applicant is a partnership, the <br />application and any license, bond or insurance policy shall be made and issued in <br />the names of all the partners. <br /> <br />130.096 - Renewal Application. Applications for the renewal of an existing license <br />shall be made at least sixty (60) days prior to the date of the expiration of the <br />license and shall be made in such abbreviated form as the City Council may approve. <br />If, in the judgment of the Council, good and sufficient cause is sho~aby any appli- <br />cant for his failure to file for a renewal within the time provided, the Council may, <br />if the other provisions of this section are complied with, waive this requirement and <br />grant the application. <br /> <br />130.097 - License Fees. The following provisions control as to license fees and re- <br />lated subjects: <br /> <br /> 1. The ar~nual license fee for an "off-sale" license shall be as provided in <br />Chapter 130.0110. <br /> <br /> 2. The annual license fee for an "off-sale" wine license shall be as provided in <br />Chapter 130.0110. <br /> <br /> 3. The ar~nual license fee shall be paid in full before the application for a <br />license is accepted. Ail fees shall be paid into the general fund of the city. Ail <br />licenses shall expire on the last day of June of each year. Upon rejection of any <br />application for a license, or upon withdrawl of application before approval of the <br />issuance by the City Council, the license fee shall be refunded to the applicant. <br /> <br /> 4. The fee for an "off-sale" and "on-sale" wine license granted after the commence- <br />ment of the license year shall be pro-rated on a monthly basis. <br /> <br /> 5. When the license is for a premises where the building is not ready for occupancy, <br />the time fixed for payment of the license fee for the initial license period shall be <br />ninety (90) days after approval of the license by the city council or upon the date the <br />building is ready for occupancy, whichever is sooner. <br /> <br /> 6. No part of the fee paid for any license issued under this chapter shall be <br />refunded except in the following instances upon application to the council within <br />thirty (30) days from the happening of the event. The coumcil may in its judgment <br />refund a pro rata portion of the fee for the unexpired period of the license, com- <br />puted on a monthly basis, when operation of the licensed business ceases not less <br />than one (1) month before expiration of the license because of: <br /> <br /> a. Destruction or damage of the licensed premises by fire or other <br />casastrophe~ <br /> <br /> b. A change in the legal status of the municipality making it unlawful <br />for a licensed business to continue; <br /> <br /> c.
