7. At the time of each original applicatiom for a license, except in the case of <br />an "on-sale" club license, the applicant shall pay in full to the city clerk an in- <br />vestigating fee as established from time to time by city council resolution. No in- <br />vestigating fee shall be refumded. <br /> <br /> 8. At any time that an additional investigation is required because of a change <br />in the ownership or control of a corporation or because of an enlargement, alteration, <br />or extension of premises previously licensed, the licensee shall pay an additional <br />investigating fee in an amount as established from time to time by city council reso- <br />lution. <br /> <br /> 9. Where a new application is filed as a result of incorporation by an existing <br />licensee and the ownership, control and interest in the license are unchanged, no <br />additional license fee will be required. <br /> <br />130.098 - Granting of Licenses. The following procedure shall be followed in process- <br />ing applications for licenses ~nder this section: <br /> <br /> 1. All applications for a license shall be referred to the chief of police and to <br />such other city department as the city council shall deem necessary for verification <br />and investigation of the facts set forth in the application. The chief of police shall <br />cause to be made such investigation of the information requested in Chapter 130.094 as <br />shall be necessary and shall make a written recommendation and report to the city <br />council, which shall include a list of all violations of federal or state law or <br />municipal regulations. <br /> <br /> 2. Upon receipt of the written report and recommendation by the chief of police <br />and at the next regularly scheduled meeting thereafter, the city council shall in- <br />struct the city clerk to cause to be published in the official newspaper, ten (10) <br />days in advance, a noti-e of a hearing to be held by the city council, setting forth <br />the day, time and place when the hearing will be held, the name of the applicant, the <br />premises where the business is to be conducted, and such other information as the city <br />council may direct. Within forty-five (45) days after the hearing, the council may <br />either grant or deny the license. If the license is granted, the council may withhold <br />its issuance until the applicant has qualified in all respects for the license. If <br />the premises to be licensed are not complete at the time that the hearing is con- <br />ducted, the council may grant the license, but shall withhold its issuance until the <br />premises have been completed in accordance with the representations made by the appli- <br />cant. Notwithstanding any requirement of this section or any section of this chapter, <br />the city shall not be required to issue the initial off-sale licenses premitted under <br />this chapter until October 1, 1978. <br /> <br /> 3. No transfer of a license shall be permitted from place to place or person to <br />person without complying with the requirements of any original application, and each <br />such transfer shall require the approval of the city council and the liquor control <br />commissioner. <br /> <br /> 4. The clerk shall, within ten (10) days after the issuance of any license under <br />this section, submit to the liquor control commissioner the full name and address of <br />each person granted a license, the trade name, the effective license date, and the <br />date of expiration of the license. He shall also submit to the liquor control com- <br />missioner any change of address, transfer, cancellation, or revocation of any license <br />by the council during the license period. <br /> <br />-5- <br /> <br /> <br />
