<br /> SECTION 1. SHORT TITLE
<br /> '~his OrdlnahCi~ shall be known a~' the!City Of
<br /> Ramsay Interim~Zoning ordinance.'~: · '' '
<br /> SECTI°N 2~ P~URPOSES, ~ r,.. ~_
<br /> (a) The City council has determined that the.
<br /> City's pre,eat Comprehensive Plan and im-
<br /> plementing' Zoning'Ordinance as it affects the
<br /> Southeast quads'ant of the: City is inadequate to
<br /> provide for q[derly development, pr0tec~t public and
<br /> pr!vate prO~e~y =and to Pror~ote the health, safety,
<br /> orde~ and c0~venlen~:e and t~e ger~eral welfare of fha
<br /> citizens Of the~ cd~munity.. : r '~
<br /> (b) In order to elirnirfate~ the. inadequacies as
<br /> outlined in Paragraph (a) above, .the City has
<br /> authorize~l an' Urban Plannihg District Sludy which
<br /> study.has b~n forwarded to the City Council by the
<br /> Ramsay Planning and Zoning Commtssiqn in a
<br /> resolution adopted March' 29, 1976." '
<br /> '(c) That the.City Council .finds that if it is to for-
<br /> mally adopt the Urban Planning DlstFict Study and
<br /> implementihg Zoning Ordinance;.~etroPOlitan~
<br /> C~uncil [revlew alon~ with recluired.pubUc~ hearings
<br /> will be necessary; ....
<br /> (d) :l=inaily, the City Councit finds that in order 'to
<br /> prote~:t the planning process as described above, this
<br /> interim ordidance is necessa.ry,'and it is ,adopted
<br /> 'pursuant to authorit'y granted in M.S. Chapter 473.
<br /> The maximum duration of this Ordinance shall
<br />one year from and after its effective date.

<br />bounded as follows are hereby repealed:
<br />The Rum River on the East; the North line of
<br />Sections Twenty-four (24), Twenty~three (23);
<br />the West line Of Section Twenty-three (23); the
<br />North line of Section 26 West of Sunfish Lake
<br />Bou|evard; Sunfish Lake Boulevard - within
<br />Section 26; Industry Avenue and the Ramsey-
<br /> Anoka boundary.line. '.
<br /> That area lying within the above-described
<br /> property, for purposes of this'lnt~'im Zoning Or*
<br /> dinance, shall be placed in a Conditional use Zone
<br /> classification~ and Section 2.1 Of City of Ramsay
<br /> Zoning Ordinance No. 73-5 shall.be amended ac-
<br /> cordingly.
<br /> SECTION 4. CONDITIONAL USE PERMIT
<br /> No new use of any land within the Conditional U~e
<br /> Zone as defined In Section 3 above shall be permitted
<br />~ without first obtaining a conditional use permit as
<br /> provided for in Sections 7.2 through 7.5r of the
<br /> Ramsay Zoning Ordinance 73.5. The primary and
<br /> controlling criteria to be used by the Planning
<br /> Commission and City Council in evaluating whether
<br /> or not to grant a conditional use permit shall be the
<br /> policies and guidelines as ~:ontained:in the "City of
<br /> Ramsay Urban Planning District Study RepOrt"
<br /> forwarded to the Ramsay City Council by motion of
<br /> ~ RamSay Planning and Zoning Cor~mission on
<br /> h 29, 1976.
<br /> C~ION 5..EXEMPTION : . . :

<br /> e~mpt from the provisions Of this ordinance.
<br /> SECTION 6. REPEAL
<br /> Ordinance .No. 75-9 is hereby repealed.
<br /> SECTION 7. ENFORCEMENT PENALTIES
<br /> Any violation Of this Ordinance may be enjoined by
<br /> the City Council thrOugh p~oper legal Channels and
<br /> any person, firm, partnership' or corporation who
<br /> violates this oral)hence shall be guilty of a
<br /> misdemeanor upon conviction thereat bo punished
<br /> by a fine not t0 exceed Three Hundred Dollars
<br /> ($300.00) or by imprisonment for notto exceed ninety
<br /> (90) days, or both for each Offense. Each day a
<br /> violation is permitted to exist shall constitute a'
<br /> separate Offense. ,
<br /> SECTION 8. ENFORCEMENT REMEDIEs
<br /> In case any building, structure, or land is, or is
<br /> proposed to be erected, constructed, reconstructed,
<br /> altered, converted, maintained or used in violation of
<br /> this Ordinance, the City Council,' in addin0n to other
<br /> remedies, may institute in the name'of Ihe City of
<br /> Ramsay any apl~ropriate action or proceeding to
<br /> . prevent, restrain, correct or abate such built, lng,
<br /> structu, re, or land, or to preveflt, in or a .bout such
<br /> premisas~ any act, conduct, business or 'use cog.
<br /> stituting a violation.
<br /> This ordinance shall become effective upon its
<br /> adoption end publication accordln~ to law.

<br />Peter G. Bodley, being duly sworn, on oath says he is and during all the times herein stated
<br />has been the managing editor of the newspaper known as Anoka County Union and has full
<br />knowledge of the facts herein stated as follows: (1) Said newspaper is printed in the English
<br />language in newspaper format and in column and sheet form equivalent in printed space to
<br />at least 900 square inches. (2) Said newspaper is a weekly and is distributed at least once
<br />each week. (3) Said newspaper has 50 per cent of its news columns devoted to news of local
<br />interest to the community which it purports to serve and does not wholly duplicate any other
<br />publication and is not made up entirely of patents, plate matter and advertisements. (4)
<br />Said newspaper is circulated in and near the municipality which it purports to serve, has at
<br />least 500 copies regularly delivered to paying subscribers, has an average of at least 75
<br />per cent of its total circulation currently paid or no more than three months in arrears and
<br />has entry as second-class matter in its local pest-office. (5) Said newspaper purports to
<br />. serve the City of Anoka in the County of Anoka and it has its known office of issue in the City
<br />of Anoka in said County, established and open during its regular business hours for the
<br />gathering of news, sale of advertisements and sale of subscriptions and maintained by
<br />Thomas B. Pease or persons in its employ and subject to his direction and control during all
<br />such regular business hours and at which said newspaper is printed. (6) Said newspaper
<br />files a copy of each issue immediately with the State Historical Society. (7) Said newspaper
<br />is made available at single or subscription prices to any person, corporation, partnership or
<br />other unincorporated association requesting the newspaper and making the applicable
<br />payment. (8) Said newspaper has complied with all the foregoing conditions for at least one
<br />year preceding the day or dates of publication mentioned below. (9) Said newspaper has
<br />filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1
<br />thereafter an affidavit in the form prescribed by the Secretary of State and signed by Arch
<br />G. Pease and sworn to before a notary public stating that the newspaper is a legal
<br />newspaper.
