ORDINANCE NO. 76-2 CITY OF RAMSEY ANOKA COUNTY, MINNESOTA AN ORDINANCE AMENDING CITY OF RAM- SLY ZONING ORDINANCE NO. 73-5 AND REPEALING ORDINANCE NO. 75-9. SECTION I. SHORT TITLE This Ordinance shall be known as the City of Ramsay Interim Zoning Ordinance. SECTION 2. PURPOSES (a) The City Council has determined that the City's present Comprehensive Plan and ira- plementing Zoning Ordinance as it affects the Southeast quadrant of the City is inadequate to provide for orderly development, protect public and private property and fo promote the health, safety, order and convenience and thegeneral welfare of the citizens of the community. (b) In order to eliminate the inadequacies as outlined in paragraph (a) above, the City has authorized an Urban Planning Oistrict Study which study has been forwarded to the City Council by the Ramsey Planning and Zoning Commission in a resolution adopted March 29, 1976. (c) That the City Council finds that if it is to for- mally adopt the Urban Planning District Study and implementing Zoning Ordinance, Metropolitan Council review along with required public hearings will be necessary. (d) Finally, the City Council finds that in order to prolect the planning process as described above, this interim ordinance is necessary, and it is adopted pursuant 1o authority granted in M.S. Chapter 473. The maximum duration of this Ordinance shall be one year from and after its effective date. SECTION 3. CONDITIONAL USE ZONE CLASSIFICATION. All presenl zoning use districts within the area bounded as follows are hereby repealed: The Rum River on the East; the North line of Sections Twenly.four (24), Twenty.three (23); the West line of Section Twenty-three (23); 1he North line of Section 26 West of Sunfish Lake Boulevard; Sunfish Lake Boulevard within Section 26; Industry Avenue and the Ramsey- Anoka boundary line. That area lying within the above.described properly, for purposes of this Interim Zoning Or- dinance~ shall be placed in a Conditional Use Zone classification, and Section 2.1 of City of Ramsay Zoning Ordinance No. 73-5 shall be amended ac- cordingly. SECTION 4. CONDITIONAL USE PERMIT No new use of any land within the Conditional Use Zone as defined in Section 3 above shall be perm itted without first obtaining a conditional use permit as provided for in Seclions 7.2 through 7.5 of 1he Ramsey Zoning Ordinance 73-5. The primary and controlling criteria to be used by 1he Planning Commission and City Council in evaluating whether or not to grant a conditional use permit shall be the policies and guidelines as contained in the "City of Ramsey Urban Planning District Study Report" forwarded to the Ramsey City COUncil by motion of the Ramsey Planning and Zoning Commission on March 29, 1976, SECTION 5. EXEMPTION The single family dwelling use of a previously platted tot or parcel one acre or less in size shall be exempt from the provisions of this ordinance. SECTION 6. REPEAL Ordinance No. 75-9 is hereby repealed. SECTION 7. ENFORCEMENT PENALTIES Any violation of this Ordinance may be enioined by fha City Council through proper legal channels and any person, firm, partnership or corporation who violates this ordinance shall be guilty of a misdemeanor upon conviction thereof be punished by a fine not to exceed Three Hundred Dollars ($300.00) or by imprisonment for not to exceed ninety (90) days, or both for each offense. Each day a violalion is permitted to exist shall constitute a separate offense. SECTION 8. ENFORCEMENT REMEDIES In case any building, structure, or land ist or is proposed to be, erected, constructed, reconstructed, altered, converted, maintained or used in violation of this Ordinance, the City Council, in addition to other remedies, may institute in the name of the City of Ramsay any appropriate action or proceeding to prevent, restrain, correct or abate such building, structure, or land, or to prevent, in or about such premises, any act, conduct, business or use con- sfituting a violation. This ordirlance shall become effective upon its adoption and publication according to law. Adopted this 27th day of April, 1976, by the City Council of the City of Ramsey, Anoka County, Minnesota.
