ORDINANCE NO. 75~8 CITY OF RAMSEY ANOKA COUNTY, MINNESOTA ANOR'DINANCE FOR THE /V~ANAGEMENT OF SHORELAND AREAS OF THE CITY OF RAMSEY. The City Council, City of Ramsey, ordains: SECTION 1.. PURPOSE. The uncontrolled use of shoreland in t~e City of Ramsey affects the public health, safety and general ~velfarenot only by contributing to pollution of public waters, but also by impairing the local tax base. Therefore, if is in the Pest interests of the public health, safety and welfare to provide for the wise development of shorelands of public waters in order to preserve and enhance the quality of surface waters, preserve the economic and natural en- virenmental values of shorelands and to provide for the wise utilization of waters and related land resources. It is, therefore, the purpose of this Or- dinance to achieve these above.described goals. SECTION 2. SHORELANDS AFFECTED The public waters of the City of Ramsey affected by this Ordinance are as follows: Mississippi River Rum River Trout Brook Ford Brook SU~ish Lake Lake Itasca Eddy Lake Rc~ers Lake These unnamed'bodies of water located in the S6uth one-half (S¥2) of Section 26, Township 32, Range 25 . ~ECTION 3. DEFINITION. The definition of a high water line shall be deter- mined from the geological survey topographic map done to the largest scale available and shall be at an elevation as determined by the City Engineer. SECTION 4. RESTRICTIONS. (a) Any presmises intended for human occupancy and lying within 300 feet of the high water line of any of the bodies of water named in Section 2 herein must be provided with an adequate method of sewage disposal constructed and maintained in accordance with the Minnesota Department of Health recom- mended standards, and the relevant Ramsay City Ordinances. (b) Public or municipal collection and treatment facilities must be used where available and where feasible. (c) Location and installation of the individual sewage disposal system shall be such that with reas(x~able maintenance it will function in a sanitary manner and will not create a nuisance, endanger the safety of any domestic water supply nor pollute any' waters of the State, as determined by the City Zoning Administrator. SECTION 5. ADMINISTRATION AND PERMITS, (a) Prior to construction of any individual sewage disposal facility within 300 feet of the above described high water line, it shall be necessary to make application for a permit with the City Zoning Administrator. (b) After investigation of the permit application, the Zoning Administrator shall make written finJ dings and recommendations to the City Council for its final action. The Council in its discretion may or may not grant said permit. SECTION 6. PENALTY. Any person convicted of violating this ordinance shall be punished by a fine not exceeding Three Hundred Dollars (S300.00) or by imprisonment for nqt more than ninety (~0) days, or both. SECTION. 7. EFFECTIVE DATE. This Ordinance shall be in full force and effect from and after its passage a nd publication according to law. PASSED by the City Council this 23rd day of June, 1975. -s- Arnold G.
