ORDINANCE NO. 75~8 <br /> CITY OF RAMSEY <br /> ANOKA COUNTY, MINNESOTA <br /> <br /> ANOR'DINANCE FOR THE /V~ANAGEMENT OF <br />SHORELAND AREAS OF THE CITY OF RAMSEY. <br /> The City Council, City of Ramsey, ordains: <br /> SECTION 1.. PURPOSE. <br /> The uncontrolled use of shoreland in t~e City of <br />Ramsey affects the public health, safety and general <br />~velfarenot only by contributing to pollution of public <br />waters, but also by impairing the local tax base. <br />Therefore, if is in the Pest interests of the public <br />health, safety and welfare to provide for the wise <br />development of shorelands of public waters in order <br />to preserve and enhance the quality of surface <br />waters, preserve the economic and natural en- <br />virenmental values of shorelands and to provide for <br />the wise utilization of waters and related land <br />resources. It is, therefore, the purpose of this Or- <br />dinance to achieve these above.described goals. <br /> SECTION 2. SHORELANDS AFFECTED <br /> The public waters of the City of Ramsey affected <br />by this Ordinance are as follows: <br />Mississippi River <br />Rum River <br />Trout Brook <br />Ford Brook <br />SU~ish Lake <br />Lake Itasca <br />Eddy Lake <br />Rc~ers Lake <br /> These unnamed'bodies of water located in the <br />S6uth one-half (S¥2) of Section 26, Township 32, <br />Range 25 <br />. ~ECTION 3. DEFINITION. <br /> The definition of a high water line shall be deter- <br />mined from the geological survey topographic map <br />done to the largest scale available and shall be at an <br />elevation as determined by the City Engineer. <br /> SECTION 4. RESTRICTIONS. <br /> (a) Any presmises intended for human occupancy <br />and lying within 300 feet of the high water line of any <br />of the bodies of water named in Section 2 herein must <br />be provided with an adequate method of sewage <br />disposal constructed and maintained in accordance <br />with the Minnesota Department of Health recom- <br />mended standards, and the relevant Ramsay City <br />Ordinances. <br /> (b) Public or municipal collection and treatment <br />facilities must be used where available and where <br />feasible. <br /> (c) Location and installation of the individual <br />sewage disposal system shall be such that with <br />reas(x~able maintenance it will function in a sanitary <br />manner and will not create a nuisance, endanger the <br />safety of any domestic water supply nor pollute any' <br />waters of the State, as determined by the City Zoning <br />Administrator. <br />SECTION 5. ADMINISTRATION AND PERMITS, <br />(a) Prior to construction of any individual sewage <br />disposal facility within 300 feet of the above <br />described high water line, it shall be necessary to <br />make application for a permit with the City Zoning <br />Administrator. <br /> (b) After investigation of the permit application, <br />the Zoning Administrator shall make written finJ <br />dings and recommendations to the City Council for <br />its final action. The Council in its discretion may or <br />may not grant said permit. SECTION 6. PENALTY. <br /> Any person convicted of violating this ordinance <br />shall be punished by a fine not exceeding Three <br />Hundred Dollars (S300.00) or by imprisonment for <br />nqt more than ninety (~0) days, or both. <br /> SECTION. 7. EFFECTIVE DATE. <br /> This Ordinance shall be in full force and effect <br />from and after its passage a nd publication according <br />to law. <br /> PASSED by the City Council this 23rd day of June, <br />1975. <br />-s- Arnold G.
