<br />AN ORDINANCE ESTABLISHING COM-
<br />PREHENSIVE PLATTING AND REGULATIONS
<br />FOR THE LAYING OUT OF STREETS, ALLEYS,
<br />AND OTHER PUBLIC GROUNDS AND THE
<br />SUBDIVISION OF LAND ESTABLISHING THE
<br />REQUIREMENTS FOR THE APPROVAL OF
<br />SUBDIVISION PLATS WITHIN THE CITY OF
<br />RAMSEY, ANOKA COUNTY, MINNESOTA,
<br />PURSUANT TO THE AUTHORITY GRANTED BY
<br />STATE LAW AND PROVIDING PENALTIES FOR
<br />THE VIOLATION OF THIS ORDINANCE.
<br /> THE CITY COUNCIL OF THE CITY OF RAMSEY
<br />ORDAINS.
<br /> SECTION 1, SHORT TITLE.
<br /> This ordinance shall be known as the "Subdivision
<br />~.Ordinance of the City of Ramsey", and will be
<br />referred to herein as "this ordinance".
<br />SECTION 2, INTERPRETATION AND SCOPE,
<br />All land subdivision within the City of Ramsay
<br />shall equal or exceed the standards set forth in this
<br />ordinance. The standards established by this or-
<br />dinance are not Jnlended to repeal, abrogate, annul
<br />or impair private agreements or restrictive
<br />covenants running with the land which are equal fo
<br />or more restrictive than the standards hereby
<br />established, except that the most restrictive shall
<br />apply.
<br /> SECTION 3, PLATTING AUTHORITY,
<br /> The City Council shall serve as the Platting
<br />Authority of the City in accordance with M.S.
<br />Chapter 462, and specifically M.S. 462.358. No plat,
<br />replat, subdivision of land or registered land survey
<br />shall be filed or accepted for filing by the Registrar
<br />of Titlesor Register of Deeds of Anoka County unless
<br />it is accompanied by a certified copy of a resolution
<br />adorned by the affirmalive vote of a majority of the
<br />members of the City Council approving such plat,
<br />reptat, subdivision of land or registered land survey.
<br /> SECTION 4. DEFINITIONS·
<br /> For the purpose of this ordinance, certain words
<br />and terms are hereby defined as follows:
<br /> ALLEY is a public right-of.way which affords a
<br />secondary means of access to abutting property·
<br /> BLOCK is an area of land within a subdivision that
<br />is entirely bounded by streets, parks or by streets
<br />and the exterior boundary or boundaries of the
<br />subdivision, or a combination of the above with a
<br />stream or lake.
<br /> ~OULEVARD is that portion Of the street right-of.
<br />waybetween the curb line and the property line.
<br /> BUTT EOT isa Iotat the end of a block and located
<br />beh,veen two corner lots.
<br /> CITY PLAN means a compilation of policy
<br />statements, goals, standards and maps for guiding
<br />thephysical, social and economic development, both
<br />private and public, of I he C ily and i ts environs.
<br /> DESIGN STANDARDS are the specifications to
<br />land owners or subdividers for the preparation of
<br />plats, both preliminary and final, indicating among
<br />other things, the optimum, minimum or maximum
<br />dimensions of such items as rights-of.way, blocks,
<br />easements and lots.
<br /> EASEMENT is a grant by a property owner for the
<br />use of a portion of land for the purpose of con-
<br />strutting and maintaining slopes or grade tran-
<br />sitlo~s or utilities, including bul not limited to,
<br />electric and telephone lines, sanitary and storm
<br />sewer lines, surface drainage ways and gas lines.
<br /> FINAL PLAT is a drawing or map of a subdivision
<br />which meets a II of the requirements of the City and is
<br />in such form as meets the requirements under the
<br />state law for purposes of recording.
<br /> GRADE, SLOPE OR GRADIENT means the
<br />vertical rise or drop from any fixed horizontal line or
<br />'point.
<br /> IMPROVEMENTS means the construction or
<br />installation of public or private utilities including,
<br />but not limited to, potable water, sanitary sewer
<br />systems, storm sewers, roads and other thorough-
<br />fares, sidewalks, curbs and gutters, paving
<br />barricades, trees and other plantings, lighting, fuel
<br />or energy and the transmission thereof, trans-
<br />portation syslems or facilities connected therewith
<br />and communication systems which are necessary,
<br />desirable or convenient in the mainlenance of the
<br />health, safety and the general welfare.
<br /> LOT is a parcel of land delineated upon and
<br />thereafter described by reference to a plat,
<br />registered land survey or auditor's subdivision, or
<br />other similar recorded dedicatory document.
<br /> OPEN SPACE is an area scl aside for the
<br />preservation of natural open spaces to counteract the
<br />effects of urban congestion and monotony.
<br />
<br /> OWNER is any person, firm or corporation, or any
<br />other legal entity, or a combination of any of them,
<br />having sufficient legal proprielary interest in the
<br />land sought to be subdivided to commence and
<br />maintain proceedings to subdivide the same under
<br />this ordinance.
<br /> PARKS AND PLAYGROUNDS are public lands
<br />andopen space in the City of Ramsay dedicated for
<br />and usable for recreation purposes.
<br /> PEDESTR lAN WAY isa public or private right-of-
<br />waywifhin or across a block to provide access for
<br />pedestrians and which may be used for utilities.
<br /> PLANNING COMMISSION is the Planning
<br />Commission of the City of Ramsay.
<br /> PRELIMI NARY PLAT is the tentative drawing or
<br />chart indicating the proposed layout of the sub-
<br />division to be submitted hereunder in compliance
<br />with the regulations including required supporting
<br />data.
<br /> PROTECTIVE COVENANTS are contracts made
<br />beh/veen private parties as to the manner in which
<br />land may be used, with the view to protecting and
<br />preserving lhe physical and economic integrity of a
<br />givon area.
<br /> REQUIRED PUBLIC IMPROVEMENTS are
<br />defined as those improvements in any proposed
<br />subdivision, including streets, water and sewer
<br />systems and storm water drainage systems, which
<br />arereduired in connection with the approval Of any
<br />plat or other subdivision.
<br /> RIGHT-OF-WAY is the area within the limits of a
<br />street, alley, pedestrian way, thoroughfareor
<br />easement.
<br />STREETS:
<br /> 1. STREET is a public right-of-way affording
<br />primary access by pedestrians and vehicles abutting
<br />properties whether designated as a street, highway,
<br />thoroughfare, parkway, road, avenue, or however
<br />otherwise designated.
<br /> 2. COLLECTOR STREET Js a street which carries
<br />traffic from minor streets to thoroughfares. It in-
<br />cludes the principal entrance streets of a residential
<br />development and streets for circulation within such a
<br />development.
<br /> 3. CU L-DE-SAC is a street with only one outlet and
<br />having an appropriate terminal for the safe and
<br />convenient reversal of traffic movement.
<br /> 4. MINOR STREET is a street used primarily for
<br />access to the abutting properties and the local needs
<br />of a neighborhood.
<br /> 5. SERVICE STREE~r, LANEOR ROAD is a street
<br />which is adjacent to a thoroughfare and which
<br />provides access to abutting properties and protection
<br />from through traffic.
<br /> 6. STREET WIDTH is the shortest distance bet-
<br />we~n the lot lines delineating the right-of-way of a
<br />street.
<br /> 7. THOROUGHFARE is a street primarily
<br />designed tocarry large volumes of traffic and serves
<br />as an arterial traffic way between various districts
<br />of the City.
<br /> SUBDIVIDER is a person, firm or corporation
<br />having sufficient proprietary interest in land in order
<br />to subdivide the same under this ordinance.
<br /> SU BD IVI SION is the division of a tract of land into
<br />twoor more lots or parcels of land for the purpose of
<br />transfer of ownership or building development. The
<br />term includes rosubdivision and, when appropriate
<br />to the context, shall relate to the process of sub-
<br />dividing or to the land subdivided.
<br /> SECTION 5. SKETCH PLAN.
<br />· $,01 Procedure
<br /> Prior to divJding any tract of land into h,vo or more
<br />Iotsor parcels of land, the subdivider shall submit a
<br />sketch plan for review by the Planning Commission.
<br />At the time of submission of the sketch plan, 1he
<br />subdivider of the land covered by the sketch plan
<br />shall submit a petition for rezoning to the proposed
<br />useof said land, if the land is not already so zoned.
<br />Theowner of sa id land shall join in said petition.
<br /> a. The subdivider shall file five (5) copies of the
<br />sketch plan with the Zoning Officer at least 21
<br />calendar days before the next regular monthly
<br />meeting of the Planning Commission at which
<br />meeting said sketch plan shall be considered.
<br /> b. At the time of submission of the sketch plan, the
<br />subdivider shall pay a fee as determined from time
<br />to time by City Council Resolution. The subdivider
<br />shall also deposit $500.00 with the City at the time of
<br />submission of the sketch plan which shall be used to
<br />defray expenses incurred by the City in employing
<br />the services of the City Engineer, attorneys and
<br />other professional consultants in connection with the
<br />review of said sketch plan. However, the sa id deposit
<br />may also be used to reimburse the City for the ex-
<br />pense of employing the services of the City Engineer,
<br />attorneys, and other professional consultants in
<br />
<br />connection with the review of the preliminary plat
<br />and final plat as prescribed in this ordinance. If said
<br />Five Hundred Dollars ($500.00) is not sufficient to
<br />defray the above expenses, additional monies will be
<br />required prior to final action on the plat, and if, in the
<br />opinion of the Zoning Officer, the deposit is depleted
<br />such that it is unlikely to be sufficient to meet the
<br />remaining anticipated expenses, the subdivider shall
<br />be required to deposit an amount sufficient to bring
<br />the account to a balance of $500.00, prior to any
<br />further action on the plat. If after final action on the
<br />proposed subdivision, a surplus balance remains in
<br />the City's accounts, said surplus balance shall be
<br />refunded to the subdivider. The said deposit shall be
<br />in addition to the fees prescribed elsewhere in this
<br />ordinance. _
<br /> c. The Zoning Officer shall distribute the copies of
<br />the sketch plan to the appropriate individuals. He
<br />shall also submit to the Planning Commission a
<br />repc~t on the relationship of the proposed land uses
<br />to those existing in the area, those indicated on the
<br />comprehensive land use plan and those provided for
<br />by existing zoning ordinances.
<br /> d. The City Engineer shall submit a report to the
<br />Planning Commission, which shall deal with
<br />drainage, traffic, utilities, and other engineering
<br />matters pertinent to the plan.
<br /> e. The Planning Commission shall consider the
<br />sketch plan, the Zoning Officer's report, the
<br />Engineer's report, and any other pertinent in-
<br />formation which they may wish to consider. The
<br />Planning Commission shall advise the subdivider of
<br />the extent to which the plan conforms to the
<br />requirements of the community and the ability of the
<br />City to provide essential services, and may discuss
<br />possible modifications necessary to secure approval
<br />of the subdivision.
<br /> f. If a petition for rezoning to land uses in con-
<br />formance with the sketch plan has been filed, the
<br />Planning Commission shall forward a written report
<br />of its findings and recommendations in regard to
<br />both the sketch plan and the rezoning to the City
<br />Council.
<br /> g. The City Council shall act on the rezoning
<br />petition in accordance with procedures established
<br />by other ordinances. The report of the Planning
<br />Commission shall become a part of the rezoning
<br />proceedings.
<br /> h. After the City Council has acted on the rezoning
<br />petition, the City Council shall advise the subdivider
<br />as Io the land uses permitted in the sketch plan and
<br />may discuss possible modifications necessary to
<br />secure approval of the subdivision. 5.02 Content
<br /> It shall be a condition to the acceptance of a sub-
<br />division sketch plan for filing with the Zoning Officer
<br />that said sketch plan shall include the data required
<br />heret~nder. The sketch plan shall be drawn at a
<br />suitable scale and shall cover all of the owner's
<br />contiguous land. A freehand rendition of graphic
<br />data shall be sufficient.
<br /> a. Identify property by fraction of Section,
<br />Township and Range.
<br /> b. Names and addresses of the owner and sub.
<br />divider of the land.
<br />c. Date and north point.
<br />d. Total approximate acreage.
<br />e. Existing zoning classification for each tract of
<br />land in and abutting the property included in the
<br />proposed subdivision.
<br /> f. Location and names of existing or platted streets
<br />andolher public ways, parks and public open spaces
<br />and section and municipal boundary lines within the
<br />proposed subdivision and to a distance of 100 feet
<br />beyond. -
<br /> g. Significant topographical features, such as hills,
<br />valleys, water courses, lakes, marshes, wooded
<br />areas, etc.
<br /> h. Proposed street pattern.
<br /> i. Proposed land use including approximate
<br />density of dwelling units for residential uses.
<br /> i. Areas intended to be dedicated or reserved for
<br />public use, including the approximate size of such
<br />areas.
<br /> SECTION 6. PRELIMINARY PLAT.
<br /> 6.01 Procedure. Prior to dividing any tract of land
<br />intotwo or more lots or parcels of land, the following
<br />procedures shall be followed:
<br /> a. The subdivider shall file five (5) copies of the
<br />preliminary plat with the Zoning Officer at least 30
<br />calendar days before the next regular monthly
<br />meeting of the Planning Commission at which
<br />meeting said plat shall be considered, and at which
<br />time the required public hearing may be held.
<br /> b. At the time of the filing of the preliminary plat,
<br />thesubdivider shall pay to the City such fees as shall
<br />be prescribed in a fee schedule adopted by City
