<br />·     ~;~    AN ORDINANCE ESTABLISHING RULES FOR
<br />           THEORGANIZATION AND PROCEDURE OF THE
<br />           ' CITY ·COUNCIL OF RA/~ASEY, MINNESOTA.
<br />           The City Council of Ram~ey ordains:
<br />           SECT!ON 1. N~EETINGS.
<br />           Subdivision 1. Regular meetings of the City Council
<br />           - shall be held on the. third N~onday of each calendar
<br />           month at 7:30 p.m. Any regular meeting falling upon
<br />           · a holiday shall be held on the next following business
<br />           day at the same time and place. A second monthly
<br />           meeting shall be held on the second Tuesday of each
<br />           calendar month at 7:30 p.m. All meetings, including
<br />           special meetings, shall be held in the City Hall or at
<br />           another public Iocafi0n as designated by the City
<br />           Council.
<br />           Subdlvisibn 2. Special meetings of the Council may .
<br />           be called by the A~ayor or by any lwo members of the
<br />           Council by writing filed with the Clerk. Af least one
<br />           day before the meeting, the Clerk'shall notify each
<br />           member of the time, place and purpose of the
<br />           meeting by causing written notice thereof to be
<br />           delivered to him personally, or if he cannot be found,
<br />           by leaving a copy at the home of the member with
<br />           some person of suitable age and discretion. Special
<br />           meetings r~ay be held w,thout prior written notice
<br />           when all council members a re present at. the meeting
<br />           or consent thereto in writing. Such consent shail be
<br />           filed with the Clerk prior to the beginning of the
<br />           meeting. Any special meeting attended by all the
<br />           Council members shall be a valid meeting for the
<br />           transaction of any. business that may come before
<br />           the meeting.
<br />           Subdivision 3. At the first regular council meeting
<br />           in January of each year, the council shall (])
<br />  · designate ihe depositories of City fuhds; (2)
<br />  designate the official newspaper; (3) choose an
<br />  acting N~ayor from the Councilmen who shall per-
<br />  form the duties of the Ntayor during the disability or
<br />  . absence of the A~ayor from the City, or in case of a
<br />  · va~ancy in the office of the A~ayor, until a successor
<br />  has been appointed and qualifies; (4) appoint such
<br />  officer's and employees and such members of boards,
<br />  commissions, and committees as may be necessary.

<br /> each Council member as soon as practicable after
<br /> the meeting. At the ne~(t regular council meeting
<br /> following such delivery, approval of the minutes

<br /> notbe read aloud, but the presiding officer shall call
<br /> for any additions or corrections. If there is no ob.
<br /> j~ction to the proposed addition or correction, it may
<br /> be made without a vote of the council. If there is an
<br /> obiection, the council shall vote upon lhe addition or
<br /> correction. If there are no additions or corrections,
<br /> the minutes shall stand .approved. N~inutes of
<br /> Council meetings shall be posted of the City Hall for
<br /> reviewal.
<br /> SECTION 4. ORDER OF BUSINESS.
<br /> Subdivision '1. Each meeting of the Council shall
<br /> convene at the time and place appointed therefore.
<br /> C~uncil business shall be conducted in the following
<br /> order:
<br />  (]) Call fo order
<br />  (2) Agenda Approval
<br />  (3) Citizen's comments
<br />  (4) Approval of minu~es
<br />  (5) Public hearings
<br /> (6) Petitions, requests and communications
<br /> (7) Ordinances'and ~esolutions
<br /> (8)' Reports of officers, boards and committees
<br /> (9) Unfinished business
<br /> (10) New business
<br /> (it) /~Aiscellaneous
<br /> (12) Paymen,t of claims
<br /> (]3) Adiobrnment
<br />    Subdivision 2. The order of business may be varied
<br />bythe presiding officer or upon Council motion; but
<br />all public hearings shall b~ held at the time specified
<br />in the notice of hearing.
<br />    Subdivision 3. An agenda of business for each
<br />regular council meetin, g shall be prepared by the
<br />Clerk and filed in the office of the Clerk not later than
<br />five (5) days next preceding the meeting. The
<br />agenda shall be prepared in accordance with the
<br />Order of business and copies thereof shall be
<br />delivered fo each council member and to the City
<br />afforney as far in advance of the meeting as time for
<br />preparation will permit. No item of business shall be
<br />considered unless if appears on the agenda.for the
<br />
<br />    Subdivision 4. All Council meetings, including    meeting, but the council may in its discretion,
<br />Special and adjourned meetings shall be open to the
<br />public,                                            consider matters not appearing on the agenda.
<br />   SECTION 2. PRESIDING OFFICER.                   SECTION 5. QUORUM AND VOTING
<br />
<br /> · Subdivision 1. The Mayor shall preside at all
<br />
<br />     meetings of the Council. In the absence of the Mayor,
<br />:. the acting Ntayor shell preside. In the absence of
<br />  both, the Clerk shall call the meeting to order and
<br />  shall preside until the Council members present at
<br />  the meeting choose one of their number to act
<br />  temporarily as presiding officer.
<br />     Subdivision 2. The presiding officer shall preserve
<br /> order, enforce the rules of procedure herein
<br />
<br /> · Prescribed, and determine without debate, subject to
<br />   the final decision of the council on appeal, all
<br />   questions of procedure and order. 'Except as
<br />   otherwise provided by statute or by these rules, the
<br />   proceedings of the council shall be conducted in
<br />   accordance with Robert's Rules of Order Revised.
<br />      Subdivision 3. Any member may appeal in the
<br />     Council f~-om a ruling of the presiding officer. If the
<br />' appeal is seconded, the presiding officer may explain
<br /> his ruling, but no othe~ council member shall par-
<br /> ticipate in. the discussion. The aPpeal shall be
<br /> sustained if it is approved by the majority of the
<br /> members present exclusive of the presiding officer.
<br />     5ubidv!sion 4. The N~ayor or such other members
<br /> of the Council as may. be ·presiding may move,
<br /> second, and debate from the chair: The presiding
<br /> officer shall not be deprived of any of the privileges
<br /> of a c(~uncil ~amber by reasdn of his acting'as the
<br /> presiding officer~
<br /> SECTION 3. /~AINUTEs.
<br />    Subdivision 1. /Vtinutes Of each council meeting
<br />shall be kept by the Clerk, or in his absence, by the
<br />Deputy Clerk. In the absence of both, the presiding
<br />officer shall appoint a secretary protein. Or.
<br />dinan~es resolutions, and claims need not be
<br />recorded in full in the minutes if they appear in other
<br />permanent records of the Clerk and can be ac-
<br />curately identified from the description'given in lhe
<br />minutes. All Council meetings shall be tape recor-
<br />ded, and the recorded tapes of each meeting shall be
<br />retained in the Clerk's office for public reviewal for a
<br />period of one (1) year from the da/e of the meeting.
<br /> Subdivision 2. The minutes of each meeting shall
<br />
<br />     Subdivision 1. At all Council meetings the majority:
<br /> of all the council .members elected shall constitute a
<br /> q[~orum for the transaction of business but a small.
<br /> er number, may adjourn from time to time and the
<br /> council may punish non-attendance by a fine not
<br /> exceeding 55.00 for each absence after one from any
<br /> meeting unless a reasonable excuse is offered.
<br />     Subdivision 2. The votes of the members on any
<br /> question pending before the council may be by voice
<br /> vote, standing vote, or in any other manner of voting
<br /> which signifies the intention of the members, and the
<br /> names of those voting for and against the question
<br /> shall be recorded in the minules. If a~y member,
<br /> being p.resent, does not vote, the minutes, as to his
<br /> name, shall be marked "Presenl--Nof Voting".
<br />     Subdivision 3. A r0aiority vote of all members of
<br /> the council shall be necessary for approval of any
<br /> ordinance unless a la~'ger number is required by
<br /> statute. Except as otherwise provided by statute, a
<br /> majority vote ~f a quorum shall prevail in all other
<br />
<br /> SECTION 6. ORDINANCES, RESOLUTIONS,
<br />N~OTIONS, PETITIONS AND CON~N~UNICATIONS.
<br /> Subdivision ]. Every ordinance and resolution
<br /> shall be presented in wriling and shall be read in full
<br /> before a vote is taken thereon; but reading 'in full
<br /> may be dispensed with by unanimous consent. All
<br /> motions shall be recorded in the minutes and stated
<br /> in full before they are submitled to a vote by the
<br /> presiding officer. All petitions and other com.
<br /> munications addresse~ fo the council shall be tn
<br /> writing and shall be read in full upon presentation fo
<br /> the council. They.shall then be recorded in the
<br /> minutes by title and filed with the minutes in the
<br /> office of the Clerk.
<br />    Subdivision. 2. Every ordinance and resolution
<br />passed by the council shall be signed by the mayor,
<br />aflested by the clerk, and filed by him in the or.
<br />dinance or resolution book. Proof of publication of
<br />every ordinance shall be attached to and filed with
<br />the ordinance.
<br /> Subdivision 3. Every ordinance or resolution

<br /> section or subdivision thereof shall give the number,
<br /> if any, and the title of the ordinance or resolution to
<br /> be repealed in whole or In pert. No ordinance or
<br /> resolution or subdivision thereof shell be amended
<br /> by reference to the title alone, but such a~efldlng
<br /> ordinance or resolution shell set forth (ri:furl. each
<br /> section or subdivision to be amended.  SECTION 7. CON~ITTEES
<br />     The Council may create such commitfess, stan-
<br /> ding or special, es it deems necessary. Such~m-
<br /> mlffees shall consist of as many member~, and
<br /> perform such duties as the Council may require.
<br />  SECTION 8. SUSPENSION OR A~ENDING OF
<br />   THE RULES.                       ,                                      I
<br /> These rules, or any of them, may be temporarily ~
<br /> suspended by a malority vote of all of the.council
<br /> members, and shell not be repealed or amerlded
<br /> except by a majority vote of the whole councll after
<br /> notice has been given ~t some preceding cOuncil
<br /> meeting.
<br /> SECTION 9. SEVERABILITY CLAUSE.
<br /> If any section, subdivision, clause of phrase of this
<br /> ordinance is for any reason held to be un.
<br /> constitutional, such decision shall not effect the
<br /> validity of the remaining portions of this ordinance.
<br /> The Council hereby declares that it would have
<br /> passed this ordinance, any section, subdivision,
<br /> Sentence, clause or phrase thereof, Irrespective of
<br /> the fact that any one or more sections, sulxlIvlslons,
<br /> sentences, clauses or phrases be declared un-
<br /> constitutional.
<br /> SECTION 10. EFFECTIVE DATE. This ordinance
<br /> shall take effect and be in force from and after its
<br /> passage and publication.
