a. The subdivider shall file fourteen (14) copies of the preliminary <br />plat with the Township clerk at least 14 calendar days before the next <br />regular monthly meeting of the Planning Commission at which meeting said <br />plat shall be considered. At the first regular monthly meeting of the Planning <br />Commission at which the preliminary plat is considered, the Planning <br />Commission shall set a time and place for a public hearing on said preliminary <br />plat as required in subsection (e) of this Section 6. <br /> <br /> d. The township engineer, prior to the first regular monthly <br />meeting at which the preliminary plat is to be considered, shall submit <br />a report to the Planning Commission, which shall deal with drainage, <br />street and other engineering matters pertinent to said preliminary plat. <br /> <br /> e. The Planning Commission shall hold a public hearing on said <br />preliminary plat after having considered it at a regular monthly meeting. <br />Notice of public hearing shall be published in the official newspaper <br />of the Township and sent to property owners within three hundred fifty <br />feet of the property to be subdivided at least ten (10) days prior to the <br />hearing date. Public notice shall consist of a general description of <br />the proposal, the time, date and place of hearing. For the purpose <br />of notification, ownership of property within three hundred fifty feet <br />shall be determined by records on file in the office of the County Auditor, <br />Anoka County. In case the plat is disapproved, the subdivider shall be <br />notified of the reason for such action and what requirements will be <br />necessary to meet the approval of the Planning Commission. The notices <br />and publications as required herein shall be done by the subdivider and . <br />shall be paid by the subdivider. The Planning Commission shall conduct <br />the hearing on the preliminary plat and shall make its report to the Town <br />Board at its next town meeting after said hearing. It shall be the duty of <br />the Planning Commission to determine whether the preliminary plat conforms <br />with or exceeds the design standards established by this ordinance. The <br />decision of the Planning Commission with regard thereto, together with its <br />recommendations shall be included in its report to the Town Board. <br /> <br />SECTION 2. VIOLATION AND PENALTY. <br /> <br /> Any person, firm or corporation violating any of the provisions of <br />this ordinance shall be guilty of a misdemeanor, and upon conviction thereof <br />shall be punished by a fine of not more than Three Hundred Dollars ($300.00) <br />or by imprisonment not to exceed ninety (90) days for each offense. <br /> <br /> The platting, replatting, subdividing or conveyance of land not in <br />accordance with the requirements of this ordinance may be enforced by <br />mandamus, injunction, or any other appropriate remedy in any Court of <br />competent jurisdiction. <br /> <br /> <br />
