4:00 p.m. for the purposes of physical education classes and other education and extracurricular <br /> activities. All other school activities will be considered by the City based upon availability (i.e. <br /> weekend tournaments, the annual Field Day, other school functions), by the submission of the <br /> City's Special Event Permit request. <br /> XIV. ATHLETIC FIELD MAINTENANCE COSTS <br /> The School shall pay to the City the established fee for field maintenance consistent with <br /> fees charged by the City to other youth athletic organizations, for athletic field maintenance <br /> requested (chalking, dragging, stripping of lines). This specific maintenance shall be requested <br /> on the City's on-line park and facility reservation system. This agreement does not preclude the <br /> School from performing certain athletic field maintenance at the Park, however this maintenance <br /> if desired by the School, would be addressed in the annual Addendum referenced in paragraph <br /> XXII below. <br /> XV. USE BY CITY <br /> The City reserves the right to utilize and maintain the Park when School games, practices <br /> and activities are not scheduled. Further, the City may preempt the Schools scheduled day-time <br /> use of the Park, if it is deemed to be reasonable and in the City's interest to do so. The City shall <br /> attempt to provide at least 7 days advance notice for any such occurrence however, certain <br /> maintenance activity like repairing irrigation breaks may prevent the aforementioned advance <br /> notice. <br /> XVI. PARK USE NOT COVERED BY THIS AGREEMENT <br /> This agreement does not address in any way the use or development of the Northeast parcel of <br /> the Park property notated in the attached Exhibit A. Use or development of this parcel may be <br /> performed by a future amendment to this agreement, or by another instrument. <br /> XVII. OFFICERS AND BOARD MEMBERS <br /> The School shall post on their web site a copy of their most current board roster and contact <br /> information, constitution, bylaws, criminal background check policy, grievance procedures and <br /> playing rules. The School shall post any adopted changes to this information in a timely manner, <br /> as an update to their web site. If the School does not have a web site, they shall make a hard copy <br /> available to the public when requested. <br /> XVIII.PACT CHARTER SCHOOL APPEALS PROCESS <br /> It is the understanding of the parties that persons wishing to submit concerns and/or <br /> complaints related to any School operations on the Park shall first submit such concerns and/or <br /> complaints to the School's administration and/or School Board under the School's established <br /> grievance procedures. Only if such person does not get his/her grievance addressed or resolved <br /> by such process, then he/she may appeal that issue to the City. The City's responsibility shall be <br /> limited to the review of appeals related to any alleged violation of this agreement. Should the <br /> City find that the School is engaged in conduct that is objectionable or contrary to City's interests <br /> or detrimental to or against the public interests, the City may choose to cancel this agreement <br /> should such conduct continue after written notice of such conduct is received by the School and <br /> the School has an opportunity to cure such conduct. <br /> 4 <br />
