property to the extent such damage is caused by the City's use of the School's parking areas for <br /> the foregoing purposes. <br /> IX. NON-DISCRIMINATION <br /> During the performance of its respective duties and responsibilities, as related to the <br /> execution of this agreement, the School shall not discriminate on the basis of race, creed, color, <br /> age, national origin, religion, gender or disability in accordance with current state or federal laws. <br /> X. INDEMNIFICATION/INSURANCE <br /> The City shall not be liable to the School or its agents, officials, employees, contractors, <br /> members and participants for any damage to person or property caused by an act of negligence or <br /> malfeasance of the School or its agents, officials, employees, contractors, members or participants, <br /> and the School agrees to indemnify and hold harmless the City,its agents, officials and employees and <br /> contractors from any and all claims for any such damage arising out of the activities of the School, its <br /> agents, officials, employees, contractors, members and participants. The School shall provide the <br /> City, at least thirty (30) days prior to the beginning of each playing season(unless a shorter period <br /> of time is acceptable to the City),with a policy of public liability insurance in a reasonable amount <br /> to be agreed upon by the City. Likewise,the City shall provide the School documentation of public <br /> liability insurance for permitted parking on the School property if requested. <br /> XI. FOOD/DRINK AND OTHER SALES <br /> All food or drink prepared, served, sold,or stored shall be done so in strict conformity with <br /> all City ordinances, county, state and federal statutes. <br /> XII. CRIMINAL BACKGROUND CHECKS <br /> One of the primary goals of the City is to continually ensure the safety and welfare of its <br /> youth during their participation in all sports and athletic activities that occur on or in City athletic <br /> facilities. The School shall conduct criminal background checks on all persons acting as head <br /> coaches,board members and any other person acting in an official capacity and directly overseeing <br /> its youth activities occurring within the Park. These checks shall be conducted prior to the <br /> beginning of each playing season and shall remain valid for the calendar year. The School shall <br /> employ a reputable company licensed by the State of MN to conduct such checks. The School <br /> shall also maintain and publish a criminal background check policy to be used for determining <br /> an individual's eligibility to coach. Should an individual be disqualified as a result of the check, <br /> the School will prohibit that individual from serving in any official capacity with school activities. <br /> XIII. SCHEDULES AND RESERVING FIELD <br /> The School shall furnish to the City a full schedule for each seasonal sport(s)requiring the <br /> use of the Park within thirty (30) days prior to the beginning of each season via the City's on-line <br /> reservation system. Any additions or changes to any schedules requiring the use of the Park may <br /> be considered and submitted on-line to the City. The intentions and expectations for the upcoming <br /> year, would also be generally addressed in the annual Addendum referenced in paragraph XXII <br /> below. <br /> The School shall have use of the agreed-to athletic field(s) on each school day from 8:00 a.m. to <br /> 3 <br />
