1 (4) Upon receipt in proper form of the application and other requested materials, the planning 2 commission shall conduct a public hearing in the manner prescribed in article II, division 2 of 3 this chapter. 4 (6) To defray the administrative costs of processing requests for an amendment to this subdivision, 5 a fee not exceeding administrative costs shall be paid by the petitioners. Such fee shall be 6 determined by the council. 7 (E) Conditional use permit review. 8 (1) A copy of all notices of any public hearing, or where a public hearing is not required, a copy 9 of the application to consider issuance of a conditional use permit shall be sent so as to be 10 received by the commissioner at least 30 days prior to such hearings or meetings to consider 11 issuance of a conditional use pelntit. A copy of the decision shall be forwarded to the 12 commissioner within ten days of such action. 13 (F) Enforcement. It is declared unlawful for any person to violate any of the terms and provisions of this 14 subdivision. Violation thereof shall be a misdemeanor. Each day that a violation is peiniitted to exist 15 shall constitute a separate offense. 16 (1) In the event of a violation or a threatened violation of this subdivision, the city or the 17 commissioner of natural resources, in addition to other remedies may institute appropriate 18 actions or proceedings to prevent, restrain, or abate such violations or threatened violations. 19 (2) Any taxpayer of the city may institute mandamus proceedings in the district court to compel 20 specific performance by the proper official of any duty required by this subdivision. 21 22 960 Tower Overlay District 23 Tower Overlay District. The intent of this district is to accommodate the communication needs of residents 24 and business, while protecting the public health, safety, and general welfare of the community. The Tower 25 Overlay District must not be applied to the Wild and Scenic River, Mississippi River Corridor Critical Area, 26 or Shoreland Overlays. 27 28 961-969 Reserved. 29 30 970 Highway 10 Signage Overlay District 31 Highway 10 Signage Overlay District is a district for purposes of allowing additional signage in a 32 specified area due to limited visibility created by overpasses on Highway 10, described as all business 33 zoned property located within 750 feet of the centerline of Highway 10 between the eastern border of the 34 City of Ramsey and the centerline of Llama Street. Parcels located within the COR Zoning District are 35 excluded from this overlay district, as sign regulations for that district are located in a separate section 36 of the City Code. 37 38 971-979 Reserved. 39 40 980 Game Fair Parking Overlay District 41 The "GF Game Fair parking overlay district," is established as shown on the official zoning map 42 accompanying this chapter.
