1 (4) Upon receipt in proper form of the application and other requested materials, the planning <br />2 commission shall conduct a public hearing in the manner prescribed in article II, division 2 of <br />3 this chapter. <br />4 (6) To defray the administrative costs of processing requests for an amendment to this subdivision, <br />5 a fee not exceeding administrative costs shall be paid by the petitioners. Such fee shall be <br />6 determined by the council. <br />7 (E) Conditional use permit review. <br />8 (1) A copy of all notices of any public hearing, or where a public hearing is not required, a copy <br />9 of the application to consider issuance of a conditional use permit shall be sent so as to be <br />10 received by the commissioner at least 30 days prior to such hearings or meetings to consider <br />11 issuance of a conditional use pelntit. A copy of the decision shall be forwarded to the <br />12 commissioner within ten days of such action. <br />13 (F) Enforcement. It is declared unlawful for any person to violate any of the terms and provisions of this <br />14 subdivision. Violation thereof shall be a misdemeanor. Each day that a violation is peiniitted to exist <br />15 shall constitute a separate offense. <br />16 (1) In the event of a violation or a threatened violation of this subdivision, the city or the <br />17 commissioner of natural resources, in addition to other remedies may institute appropriate <br />18 actions or proceedings to prevent, restrain, or abate such violations or threatened violations. <br />19 (2) Any taxpayer of the city may institute mandamus proceedings in the district court to compel <br />20 specific performance by the proper official of any duty required by this subdivision. <br />21 <br />22 960 Tower Overlay District <br />23 Tower Overlay District. The intent of this district is to accommodate the communication needs of residents <br />24 and business, while protecting the public health, safety, and general welfare of the community. The Tower <br />25 Overlay District must not be applied to the Wild and Scenic River, Mississippi River Corridor Critical Area, <br />26 or Shoreland Overlays. <br />27 <br />28 961-969 Reserved. <br />29 <br />30 970 Highway 10 Signage Overlay District <br />31 Highway 10 Signage Overlay District is a district for purposes of allowing additional signage in a <br />32 specified area due to limited visibility created by overpasses on Highway 10, described as all business <br />33 zoned property located within 750 feet of the centerline of Highway 10 between the eastern border of the <br />34 City of Ramsey and the centerline of Llama Street. Parcels located within the COR Zoning District are <br />35 excluded from this overlay district, as sign regulations for that district are located in a separate section <br />36 of the City Code. <br />37 <br />38 971-979 Reserved. <br />39 <br />40 980 Game Fair Parking Overlay District <br />41 The "GF Game Fair parking overlay district," is established as shown on the official zoning map <br />42 accompanying this chapter.
