1 7. Address dust, noise, stoini water management, possible pollutant discharges, days <br />2 and hours of operation, and duration of operations; <br />3 8. Describe any anticipated vegetation and topographic alterations outside the pit, and <br />4 reclamation plans consistent with the stated end use for the land; and <br />5 9. Existing and new nonmetallic mining operations must submit land reclamation <br />6 plans to the local government compatible with the purposes of this section. <br />7 e. River -dependent uses. River -dependent uses must comply with the following design <br />8 standards: <br />9 1. Structures and parking areas, except shoreline facilities and private roads and <br />10 conveyances serving river -dependent uses as provided in section 920(L) <br />11 (exemptions), must meet the dimensional and perfoiniance standards in this <br />12 section must be designed so that they are not readily visible, and must be screened <br />13 by establishing and maintaining natural vegetation; <br />14 2. Shoreline facilities must comply with Minnesota Rules, chapter 6115 and must: <br />15 (i) Be designed in a compact fashion so as to minimize the shoreline area <br />16 affected; and <br />17 (ii) Minimize the surface area of land occupied in relation to the number of <br />18 watercraft or barges to be served; and <br />19 3. Dredging and placement of dredged material are subject to existing federal and <br />20 state permit requirements and agreements. <br />21 f. Wireless communication towers. Wireless communication towers are subject to the following <br />22 additional design standards: <br />23 1. The applicant must demonstrate that functional coverage cannot be provided through <br />24 co -location, a tower at a lower height, or a tower at a location outside of the MRCCA; <br />25 2. The tower must not be located in a bluff or shore impact zone; and <br />26 3. Placement of the tower must minimize impacts on public river corridor views. <br />27 (F) Structure height and placement and lot size. <br />28 (1) Purpose. To establish standards that protect primary conservation areas and public river <br />29 corridor views from development impacts and ensure that new development is sited consistent <br />30 with the purpose of the MRCCA. <br />31 (2) S'tructure height. Structures and facilities must comply with the following standards unless <br />32 identified as exempt in section 920(L)): <br />33 a. Structures and facilities must comply with the following standards unless identified as <br />34 exempt in 920(L): <br />35 1. ROS District: 35 feet. <br />36 2. RN District: 35 feet. <br />37 3. SR District: Height is determined by underlying zoning, provided the allowed <br />38 height is consistent with that of the mature treeline, where present, and existing <br />39 surrounding development, as viewed from the OWHL of the opposite shore. <br />40 b. Height is measured on the side of the structure facing the Mississippi River. <br />41 c. In addition to the conditional use permit requirements of section 920(C)(4), criteria for <br />42 considering whether to grant a conditional use pelntit for structures exceeding the height <br />43 limits must include: <br />44 1. Assessment of the visual impact of the proposed structure on public river corridor <br />45 views, including views from other communities; <br />46 2. Determination that the proposed structure meets the required bluff and OHWL <br />47 setbacks; <br />48 3. Identification and application of techniques to minimize the perceived bulk of the <br />49 proposed structure, such as: <br />50 (i) Placing the long axis of the building perpendicular to the river; <br />51 (ii) Stepping back of portions of the facade; <br />52 (iii) Lowering the roof pitch or use of a flat roof; <br />Attachment A — Ordinance #23-14 <br />Page 93 of 141 <br />
