The City has been notified that this month the Minnesota Building Codes and Standards <br />Division will be converting from the Uniform Building Code to the International Building Code <br />(IBC). Municipalities that enforce the State Building Code need to update their building code to <br />reflect the change. The ordinance proposed at this time is self-perpetuating and will always <br />reflect the most current edition of the State Building Code. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Pearson, to introduce an <br />ordinance to adopt the Minnesota State Building Code. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Kurak, Pearson, Cook, Elvig, <br />Strommen, and Zimmerman. Voting No: None. <br /> <br />Case #6: Request for Final Plat Review of Sandy Acres; Case of Michael Schelkoph <br /> <br />Principal Planner Trudgeon stated that Michael Schelkoph has applied for final plat approval to <br />subdivide his homestead (approximately 4.7 acres) on Ramsey Boulevard at 153rd Avenue NW. <br />The property is zoned R-1 Residential and is located in the Central Rural Reserve Area. The <br />proposed minor subdivision is a replat of the Schelkoph homestead that will create two new lots. <br />Proposed Lot 1 is approximately 2.11 acres, and Proposed Lot 2 is approximately 2.60 acres. <br />The applicant was granted a variance by the Board of Adjustment to the 2.5-acre minimum lot <br />size and the four units per 40-acre density on August 29, 2002. The Planning Commission <br />granted sketch plan approval at its November 7, 2002 meeting. The existing homestead will <br />remain on the proposed Lot 2. The submitted final plat shows access to Ramsey Boulevard <br />dedicated to Anoka County (this dedication was requested by the County). At their November <br />14, 2002 meeting, the Park and Recreation Commission recommended park dedication and trail <br />fees be satisfied with a cash payment. Staff recommended approval of the final plat contingent <br />upon compliance with the City staff review letter dated March 6, 2003 and the developer entering <br />into a development agreement with the City. Staff noted that a re-subdivision plan was included <br />with the request to identify possible urban lots if sewer and water was extended into the area. <br />That is a common practice that has been done in the past. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Elvig, to approve the final plat <br />contingent upon compliance with the City staff review letter dated March 6, 2003 and the <br />developer entering into a development agreement with the City. <br /> <br />Further discussion: Councilmember Kurak stated that she had asked staff to address the urban <br />plat since it was not included in the case and recommended that in the future that type of plan be <br />submitted with all subdivisions. Principal Planner Trudgeon replied that they would make sure <br />that that is included in the Chapter 9 revisions. He noted that the plan does not bind anyone to <br />anything, it is only to demonstrate that a resubdivision is possible. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Kurak, Elvig, Cook, Pearson, <br />Strommen, and Zimmerman.
