11. That a portion of the Driveway not only encroaches on the minimum required setback but <br />also encroaches onto the adjacent residential property as well. <br />12. That the driveway setback specified in City Code is intended to serve multiple purposes, <br />including keeping impervious surfacing out of drainage and utility easements and <br />providing space for snow storage. <br />13. That there is no drainage and utility easement along the southern lot of the Subject <br />Property. <br />14. That the larger property sizes in this neighborhood provide ample space for snow storage. <br />15. That the Permittee has stated that they have communicated with the owner of the impacted <br />property and that they have no objection to the encroachment. <br />16. That the Permittee stated a previous owner of the Subject Property had to dig a small <br />basin in the rear yard to correct drainage problems that were resulting in water in the <br />basement and as a result, the detached accessory building had to be constructed at the <br />minimum side yard setback at the time. <br />17. That the Driveway encroachment is not readily visible from surrounding properties. <br />FINDINGS OF FACT <br />1. That the Driveway does not impair an adequate supply of light and air to adjacent property. <br />2. That the Driveway does not unreasonably increase the congestion on the public street. <br />3. That the Driveway does not have the effect of allowing any use prohibited in the R-1 <br />Residential (MUSA) — 80 district. <br />4. That the Driveway does not peiinit a lesser degree of public health, safety, and general <br />welfare protection than established by Chapter 117 of the Ramsey City Code, or penult <br />standards which are lower than those required by state law. <br />5. That the Driveway does not increase the danger of fire or endanger the public safety. <br />6. That the Driveway does not unreasonably diminish or impair established property values <br />within the neighborhood, nor in any way is the Driveway contrary to the intent of Chapter <br />117 of the Ramsey City Code. <br />7. That the Driveway is harmonious and appropriate in appearance with the existing or <br />intended character of the general vicinity and such use will not change the essential <br />character of the area. <br />8. That the Driveway does not violate the intent and purpose of the Comprehensive Plan. <br />Resolution #23-240 <br />Page 2 of 5 <br />
