Motion by Board Member Jensen, seconded by Board Member Johnson, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Board Members Jensen, Johnson, <br />Dempsey, Kociscak, and Nixt. Voting No: None. Absent: Board Member Wivoda. <br /> <br />The public hearing closed at 7:09 p.m. <br /> <br />Board Business <br /> <br />Chairperson Anderson called the regular meeting of the Board of Adjustment back to order at <br />7:09 p.m. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Dempsey, to adopt Resolution <br />#99-04-056 adopting Findings of Fact #0488 relating to Terrance and Betty Belschner's request <br />for a variance in the affirmative. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Board Members Johnson, Dempsey, <br />Jensen, Kociscak, and Nixt, Voting No: None. Absent: Board Member Wivoda. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Jensen, to approve the request <br />for a variance from Terrance and Betty Belschner to construct an accessory structure nearer the <br />front property line than the principal structure on the property known as 7319 - 162nd Lane NW, <br />and adopt Resolution #99-04-057 declaring terms of the variance. <br /> <br />Further Discussion: Commissioner Nixt questioned why Item 2 stated the accessory garage shall <br />not be located any closer than 35 feet, rather than 40 feet stated in the background. Zoning <br />Administrator Frolik stated it has been a practice of the Board to give a five-foot flexibility <br />measure. <br /> <br />Commissioner Nixt did not oppose, however, was questioning the consistency of what is being <br />requested and what is being granted. <br /> <br />Commissioner Johnson and Commissioner Jensen agreed 40 feet should be consistent through the <br />Resolution. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Board Members Johnson, Jensen, <br />Dempsey, Kociscak, and Nixt. Voting No: None.
