Motion by Board Member Nixt, seconded by Board Member Kociscak, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Board Members. Nixt, Kociscak, <br />Dempsey, and Johnson. Voting No: None. Absent: Board Members Jensen and Wivoda. <br /> <br />The public hearing closed at 7:21 p.m. <br /> <br />Board Business <br /> <br />Chairperson Anderson called the regular meeting of the Board of Adjustment back to order at <br />7:21. <br /> <br />Zoning Administrator Frolik noted that she received a fax dated May 4,1999 from Mark Hovey? <br />with the DNR stating that the DNR is okay with granting the variance with modifications that <br />lots 4,5, and 6 are measured from the waters edge and not the OHW and requesting a 75 foot <br />non-vegetative cutting along the waters edge for lots 1-6. <br /> <br />Dennis Beck, Director of Development for Northfork, stated that a small pond will be installed <br />between lots 6 and 7 and 75 feet from the high water line and questioned if Zoning Administrator <br />Frolik felt the DNR would be okay with that. Zoning Administrator Frolik stated that she will <br />have to discuss the issue with the DNR. <br /> <br />Board Member Johnson questioned if the Board is required to comply with the DNR requests. <br />Zoning Administrator Frolik stated that they are not required to comply with the DNR <br />recommendations but encouraged them to do so. <br /> <br />Board Member Johnson questioned how the no clear cut zone is defined. Zoning Administrator <br />Frolik stated that absolutely no vegetative cutting would be allowed. <br /> <br />Board Member Anderson questioned that if the Board does not adopt the DNR regulations will <br />the DNR enforce them. Zoning Administrator Frolik stated that a variance does not require the <br />approval of the DNR. <br /> <br />Board Member Johnson questioned if it would cause political difficulties if the Board does not <br />accept the DNR recommendations. Zoning Administrator Frolik stated yes. <br /> <br />Board Member Johnson feels that not allowing the homeowners to prune any of the vegetation is <br />very rigid and stated that he has a significant problem with that.
