Mr. Beck stated that he feels that it is hard to believe that they can't work something out with <br />DNR that will be beneficial to all parties involved and suggested leaving the variance as written <br />and that they will work with the DNR on the other issues. <br /> <br />Board Member Johnson stated that the allowance for the pond is not a problem and that he is <br />inclined to allow for selective cutting of the vegetation along the waters edge. <br /> <br />Board Member Nixt suggested changing the wording of item #4 and item #9 of the Findings of <br />Fact to read "provides for a minimum of not less than 150 feet from the ordinary high water <br />mark", and recommended substituting the word "minimum" for "recommended" in item #6 and <br />include after the wording "which are considered riparian" (lots 4,5, and 6 are considered <br />riparian). <br /> <br />Motion by Board Member Johnson, seconded by Board Member Nixt, to adopt Resolution #99- <br />05-075 adopting Findings of Fact #0492, amended in the affirmative and as discussed, relating to <br />a request for a variance from North Fork, Inc. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Board Members. Johnson, Nixt, Dempsey <br />and Kociscak. Voting No: None. Absent: Board Members Jensen and Wivoda. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Nixt, to approve North Fork, <br />Inc.'s request for a variance from Sections 9.21.04 (Shoreland Overlay District Development <br />Standards) and Section 9.50.33 (Streets) of the Ramsey City Code and adopt Resolution #99-05- <br />076 declaring terms of same. <br /> <br />Further discussion: Board Member Nixt suggested adding the wording on item c to read <br />"resulting in a minimum setback of 160 feet", and item d to read "resulting in a minimum <br />setback of 156 feet", and item e to read "resulting in a minimum setback of 161 feet." <br /> <br />Board Member Johnson suggested adding an item #3 stating the applicant will work with the <br />DNR on minimizing the DNR impact. <br /> <br />Board Members Johnson and Nixt amended the motion to include the wording in items c, d, and <br />e and add an item #3 stating the applicant will work with the DNR on minimizing the DNR <br />impact. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Board Members. Johnson, Nixt, Dempsey, <br />and Kociscak. Voting No: None.
