Chairperson Anderson called the regular meeting of the Board of Adjustment back to order at <br />7:15 p.m. <br /> <br />Chairperson Anderson noted that item #2 in the findings of facts should read 20, not 200. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Kociscak, to adopt Resolution <br />#99-10-188 adopting Findings of Fact #0506 relating to Philip Johnson's request for a variance <br />from the street frontage requirement. <br /> <br />Further discussion: Board Member Johnson explained that no code can anticipate all <br />circumstances and that is the reason for variances. If it is something that makes a certain mount <br />of common sense, then he is inclined to grant approval of the variance request. <br /> <br />Board Member Dempsey questioned in relation to the proposed Comprehensive Plan, would the <br />property still be considered a rural area. <br /> <br />Community Development Director Sherman replied yes. <br /> <br />Board Member Dempsey verified that four units in forty acres would be the maximum <br />development allowed. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Board Members Johnson, Kociscak, <br />Dempsey, Jensen, and Wivoda. Voting No: None. Absent: Board Member Nixt. <br /> <br />Motion by Board Member Johnson, seconded by Board Member Kociscak, to approve Phillip <br />Johnson's request for a variance from the street frontage requirement based on f'mdings of fact <br />and adopt Resolution #99-10-189 declaring terms of same. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Board Members Johnson, Jensen, <br />Kociscak, Dempsey, Nixt and Wivoda. Voting No: None. Absent: Board Member Nixt. <br /> <br />BOARD INPUT <br /> <br />Zoning Administrator Frolik stated that the November meeting of the Board of Adjustment and <br />Planning Commission need to be rescheduled due to the school board election. <br /> <br />Consensus was reached to reschedule the meetings to Monday, November 8th. <br /> <br />ADJOURNMENT <br /> <br />Motion by Board Member Johnson, seconded by Board Member Wivoda, to adjourn the <br />meeting. <br /> <br />Board of Adjustment/October 5, 1999 <br /> Page 4 of 5 <br /> <br /> <br />
