Councilmember Kurak stated that she has made the suggestion to Mr. Menard that he talk to his
neighbors about the possibility of changing the zoning in the area to mixed use or combining his
two properties to resolve the issue.

Lonny Menard, 8900 181st Avenue NW, inquired as to how many neighbors would have to be
included for the zoning to be changed to mixed use.

Councihnember Kurak replied that she was only making a suggestion; she could not give him
any direction as to what might happen.

Mayor Gamec stated that he would be opposed to the rezoning.

Community Development Director Frolik explained that if the lot was combined with the
homestead property the building could be used to park and store the homeowner's commercial
equipment, but they could have no employees.

Councilmember Kurak inquired if the Council would have to approve the combining of the two
lots.

Community Development Director Frolik replied no.

Mr. Menard stated that the problem with combining the two lots is that someone will probably
not be able to pay the price for both properties.

Councilmember Kurak stated that if the properties are sold together, then the accessory structure
could be utilized by whoever owns it.

Councihnember Cook inquired as to how old the building was.

Community Development Director Frolik replied that it is about 20 years old.

Mr. Menard noted that he has been paying commercial taxes for 20 years.

Community Development Director Frolik replied that the property has been used for commercial
uses for 20 years and property is taxed based on use, not on zoning.

Councilmember Elvig stated that it seemed that the City was already bending some of the rules
on the property thus far and questioned if there was a way to treat this as a unique situation rather
then change the zoning in the whole area because it seems that the City might have put him in a
box.

City Administrator Norman replied that he did not agree that it was an action by the City that
created the problem.

City Council Work Session/March 18, 2003
